549.13 DISCHARGING AIR GUNS; CONFISCATION.
   (a)   Except as provided in Section 549.13 (c), no person shall discharge any air rifle, air pistol or other contrivances loaded with pellet or BB shot, slugs or any substance used in the fonn of a pellet within the City. The tenns "BB" "air rifle" or "air pistol", as used in this section mean any gun or propulsion device using compressed air or gas which propels a leaden BB or pellet, or any other kind of BB or pellet, or metal BB or metal slug.
   (b)    Any police officer of the City is authorized to confiscate any air rifle or air pistol and ammunition used in violation of this section.
   (c)    Notwithstanding the foregoing, the Safety Service Director may issue a permit to an applicant to allow a BB gun event within the corporate boundaries of the City of Alliance provided that a fully completed application is submitted with the Safety Service Director, with the following conditions:
      (1)   Submission to criminal background checks which shall demonstrate that neither the applicant, nor any of its officers or proprietors, have been convicted of any felonies or any other misdemeanor crimes which would constitute "crimes of violence" as defined by the Ohio Revised Code.
      (2)   The applicant submits a detailed drawing showing the specific location of the BB gun event, the owner of the premises where the event is to take place, proof of permission of the owner of the premises hosting the event, and acknowledgement that the event is not within 1,000 feet of any school premises.
      (3)   The applicant submits detailed drawings demonstrating that the event will take place completely within a self-contained shooting range which will be monitored by an adult who is physically present during all times of shooting. The self-contained shooting range shall be of such a character and nature so as not to permit any BB to break through the contained shooting range. The applicant must provide proper safety gear, including full face masks for all persons participating at the shooting event.
      (4)   The applicant submits proof of a certificate of liability insurance covering the event, in a minimum amount of One Million Dollars ($1,000,000).
      (5)   The beginning time and date of the event and the ending time and date of the event, which shall not exceed three consecutive days.
      (6)   Names, addresses and contact information of all persons who will monitor the self-contained shooting range during all times that the range is open or in operation.
      (7)   Acknowledgement that the event is limited to round BB projectiles only, and that any other ammunition or pellet is specifically prohibited.
      (8)   Application fee of one hundred and fifty dollars ($150.00) which shall be paid upon submission of the application.
   (d)    Whoever violates this section is guilty of a misdemeanor of the fourth degree. If however, the offense was committed on school premises or in a school building or within 1,000 feet of the boundaries of any school premises, a violation of this section is a misdemeanor of the first degree.
