3-2-20: TEMPORARY OFF PREMISES LICENSE:
   (A)   License: A temporary off premises license may be issued for a period no longer than two (2) consecutive calendar days for the purpose of allowing the licensee to sell beer or wine for purchase and consumption at a location other than the premises on which the licensee conducts their primary business and in connection with any event, picnic, carnival, fundraising program, or party at a public or semipublic facility or location.
   (B)   Application: A temporary off premises license may be issued upon an application made with the Liquor Control Commissioner at least twenty one (21) days prior to the date for when the temporary off premises license should be issued. The Mayor may, at his discretion, issue licenses upon applications made less than twenty one (21) days prior to the date for which a license is sought.
   (C)   Information From Applicant: Any temporary off premises license applicant shall submit the following information in writing:
      1.   If the applicant is not currently licensed to sell alcoholic beverages under this chapter, the applicant shall provide all information required in an application submitted pursuant to section 3-2-3 of this chapter;
      2.   To the extent it is not provided pursuant to subsection (C)1 of this section, the name of the applicant, a description of the applicant's principal place of business and a description of the off premises location for which the applicant seeks a license under this section;
      3.   If the application is for a license applicable to a premises not located on public property or within the public right-of-way, an executed copy of the lease, rental agreement or other written authority for the use of the premises if the applicant is not the owner of the premises; if the owner, then a description of the premises shall be furnished;
      4.   A statement of the applicant's plans for crowd control;
      5.   Proof that the applicant is licensed by the State of Illinois to sell the type of alcohol in the manner requested;
      6.   Certificate of insurance showing evidence of dramshop and liability insurance coverage;
      7.   The specific times and dates the applicant wishes the license to be in effect; and
      8.   The names and addresses of each authorized officer or agent of the applicant who will be responsible for organizing and administering the temporary off premises operation for which the license is sought.
   (D)   Bond: An applicant under this section shall file a bond as required under section 3-2-4 of this chapter.
   (E)   Types Of Sales, Hours: A temporary off premises license shall authorize retail sales of wine and beer over a period no longer than two (2) consecutive calendar days. Sales pursuant to a license issued pursuant to this section may begin each day no earlier than nine o'clock (9:00) A.M. Monday through Saturday and twelve o'clock (12:00) noon on Sundays and must conclude at the earlier of eleven o'clock (11:00) P.M. or in compliance with the operating hours of the event associated with the temporary off premises license. All sales must be restricted to consumption on the premises owned, leased or otherwise authorized for use by the licensee.
   (F)   Limitation On Sales: A single serving of wine shall not exceed eight (8) ounces and a single serving of beer shall not exceed twenty four (24) ounces. The licensee shall serve no more than one serving of beer or wine to a person at a time. Sales authorized by this section shall not violate subsection 3-2-15(E) of this chapter. Unless otherwise specified by this section, all sales and operations of the licensee shall be in accordance with the requirements of this chapter.
   (G)   Limitation Of Licenses: The Liquor Commissioner shall restrict the total number of temporary off premises licenses in effect on any given day to a reasonable number. No more than two (2) temporary off premises licenses may be issued to the same applicant in a twelve (12) month period. Such twelve (12) month period shall be measured backward from the date of an application for a license under this section. (Ord. 05/2016, 5-16-2016)
   (H)   Fee: The daily fee for a temporary off premises license shall be paid in full at the time the license is issued pursuant to title 13, "Schedule Of Fees", of this Code. (Ord. 12/2017, 6-5-2017)
