3-2-15: UNLAWFUL SALES; MINORS:
   (A)   Unlicensed Sale: No person shall sell, barter, transport, deliver, or offer for sale at retail, or aid or abet in any manner the sale, barter, transportation, delivery, or the offering for sale at retail, any alcoholic liquor within the corporate limits of the city, without having a valid liquor license as required by this chapter.
   (B)   Unlawful Sale To Minor: No person shall sell, give, offer, or deliver any alcoholic liquor to a minor; provided however, that a parent or legal guardian may sell, give, offer or deliver alcoholic liquor to a minor child of such parent in, or upon, private premises when such alcoholic liquor is consumed by such minor on said private premises in the presence of such minor child's parent or legal guardian, and provided further that a legal guardian may sell, give, offer, or deliver, alcoholic liquor to a minor legally in his or her custody while in or upon private premises in the presence of such guardian. Moreover, this section shall not prohibit any transfer or delivery of alcoholic liquor to a minor when done by a church or religious organization for sacramental purposes.
   (C)   Unlawful Sale To Minor By Licensee: No licensee or servant, agent or employee of said licensee shall sell, offer, give or deliver any alcoholic liquor to a minor; nor shall the licensee permit any alcoholic liquor to be sold, given, offered, or delivered to a minor while on the licensed premises of said licensee.
   (D)   Sale To Incompetent Persons By Licensee: No licensee, agent or employee of said licensee shall sell, give, offer, or deliver any alcoholic liquor to any intoxicated person, or any person known to be a habitual drunkard, or an insane, feeble minded, or emotionally handicapped person.
   (E)   Unlawful Sale Off Premises By Licensee: No licensee, or any agent or employee of such licensee shall sell, offer, give, or deliver any alcoholic liquor outside of the licensed premises, or in any premises, street, alley or place adjacent thereto. However, any licensee may sell or deliver alcoholic liquor on adjacent premises owned or leased by the licensee provided that such sale or delivery does not violate any other section of the city's liquor control ordinance.
   (F)   Illegal Possession Or Consumption: No person shall transport, carry, possess, or have any alcoholic liquor in or about a motor vehicle except in the original package and with the seal unbroken.
   (G)   Unlawful Purchase Of Alcoholic Liquor By A Minor: No minor shall purchase or attempt to purchase alcoholic liquor in or from any licensed premises or other person.
   (H)   Minor Frequenting Bar: No minor shall frequent, loiter or remain at or near a bar in any licensed premises.
   (I)   Allowing Minors To Frequent Bar: No licensee, agent, or employee of such licensee shall permit or allow a minor to frequent, loiter, or remain at or near a bar in any licensed premises.
   (J)   Prohibition On Employment Of A Minor: No licensee, agent or employee of said licensee shall allow any minor to be employed in any manner related to the tending of a bar, or the drawing, pouring, mixing, serving, or selling of alcoholic liquor in any licensed premises. The provisions of this subsection notwithstanding, employees of licensed liquor establishments whose principal business is that of a "restaurant", as defined within this chapter, may serve alcohol, provided, they are a minimum of eighteen (18) years of age and under the on site supervision of an employee or owner of said establishment who is twenty one (21) years of age or older. Such servers may also be utilized under special events liquor licenses where food is served and such event is for charitable purposes. Servers under twenty one (21) years of age shall not tend bar, mix or pour alcoholic drinks or otherwise prepare alcoholic beverages. (Ord. 05-05-08-1, 5-19-2008)
   (K)   Misrepresentation Of Age By Minor: No minor shall misrepresent his or her age for the purpose of purchasing or otherwise obtaining alcoholic liquor in or from a licensed premises. For the purpose of preventing the violation of this section, any licensee or his agent or employee may refuse to sell or serve alcoholic beverages to any person who is unable to produce adequate written evidence of identity and for the fact that he or she is over the age of twenty one (21) years.
   (L)   Unlawful To Provide Fraudulent Identification: No person shall sell, give or furnish to any minor any false or fraudulent written, printed, or photostatic evidence of the age and identity of such person; nor shall any person sell, give, or furnish to any person under the age of twenty one (21) years, evidence of age and identification of any other person.
   (M)   Alcoholic Liquor Consumption Prohibited On Class B Holder's Licensed Premises: No class B licensee or any agent or employee of such licensee shall knowingly permit any person or patron to either consume or have in his or her possession any alcoholic liquor in the original package with the seal thereon broken while on the licensed premises. Moreover, no patron shall consume or have in his or her possession any alcoholic liquor in the original package with the seal thereon broken while on the licensed premises of a class B liquor license holder.    (N)   Penalty: Any person violating any subsection of this section shall, upon conviction, pay a fine pursuant to title 12, "Schedule Of Fines", of this code. Moreover, unless the definition of a particular offense requires knowledge, each offense defined herein is malum prohibitum and proof of knowledge or intent shall not be required.
