ORDINANCE NO. 04; SERIES OF 2025
AN ORDINANCE OF THE CITY OF ALEDO,
MERCER COUNTY, ILLINOIS, AMENDING TITLE 4, CHAPTER 1 OF THE CITY CODE FOR THE PURPOSE OF ADOPTING UPDATED EDITIONS OF VARIOUS CODES PREPARED BY THE INTERNATIONAL CODE COUNCIL, THE NATIONAL FIRE PROTECTION ASSOCIATION, AND ILLINOIS REGULATIONS
 
WHEREAS, the City Council of the City of Aledo (hereinafter “City”) has previously adopted various ordinances adopting and incorporating by reference certain uniform regulations in order to ensure that buildings are constructed, reconstructed or altered in accordance with accepted and legal standards; and
   WHEREAS, the International Code Council, Inc. (the “Code Council”) is a nationally recognized authority on the techniques of constructing buildings and related supportive systems and promoting fire safety; and
   WHEREAS, the Code Council has prepared the International Building Code, 2021 Edition (the “IBC”), the International Residential Code, 2021 Edition (the “IRC”), the International Existing Building Code, 2021 Edition (the “IEBC”), the International Property Maintenance Code, 2021 Edition (the “IPMC”), the International Fire Code, 2021 Edition (the “IFC”), the International Fuel Gas Code, 2021 Edition (the "IFGC”), the International Mechanical Code, 2021 Edition (the "IMC”), and the International Swimming Pool and Spa Code, 2021 Edition (the "ISPSC”); and
   WHEREAS, the National Fire Protection Association (the “NFPA”) is a nationally recognized authority on the techniques of constructing buildings and related supportive systems and promoting fire safety; and
   WHEREAS, the NFPA has prepared the NFPA 70, National Electrical Code, 2020 Edition (the “NEC”); and
WHEREAS, the State of Illinois has adopted the Illinois Plumbing Code found at Title 77, Part 890 of the Illinois Administrative Code (the “Plumbing Code”) and the Illinois Accessibility Code found at Title 71, Part 400 of the Illinois Administrative Code (the “Accessibility Code”); and
   WHEREAS, it is in the best interests of the citizens of the City of Aledo to adopt the foregoing codes; and
   WHEREAS, Article 1, Division 3 of the Illinois Municipal Code authorizes the adoption by reference of the aforementioned codes; and
   WHEREAS, copies of the IBC, IRC, IEBC, IPMC, IFC, IFGC, IMC, ISPSC, NEC, Illinois Plumbing Code, and Illinois Accessibility Code have been available in the Office of the Aledo City Clerk for public use, inspection, and examination for more than thirty (30) days prior to the adoption of this ordinance as required by Article, Division 3 of the Illinois Municipal Code; and
   WHEREAS, as required by Section 1-2-3.1 of the Illinois Municipal Code, at least thirty (30) days before adopting each of the aforementioned codes, identification of those codes by title and edition was provided to the Capital Development Board for identification on the internet;
   NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALEDO, MERCER COUNTY, ILLINOIS, AS FOLLOWS:
   Section 1 . The recitals set forth above are found to be true and correct.
   Section 2 . Title 4, Chapter 1, Section 1 of the Aledo City Code is hereby deleted in its entirety and replaced as follows:
4-1-1: ADOPTION:
(A)   The ICC International Residential Code, edition 2021, is hereby adopted, as amended by the City of Aledo. The Code shall be the sole standard for the construction, alteration, addition and rehabilitation of all one and two-family dwellings. Compliance with the Code shall be required for all items regulated by the Code and where compliance is specifically required by the Code.
(B)   The International Code Council (ICC) International Building Code (IBC), edition 2021, is hereby adopted as the Building Code for the City of Aledo, as amended by the City of Aledo. Compliance with the Code shall be required for all items regulated by said Code and where compliance is specifically required by the Code.
(C)   The ICC International Existing Building Code, edition 2021, is hereby adopted, as amended by the City of Aledo. Compliance with the Code may be employed as an alternative to the International Building Code for those items regulated by the Code as applies to existing buildings, as defined. If using the Code as an alternative, compliance with the Code shall be required for all items regulated by the Code and where compliance is specifically required by the Code.
(D)   The ICC International Property Maintenance Code (IPMC), 2021 edition, is hereby adopted, as amended by the City of Aledo. Compliance with the Code shall be required for all items regulated by same and where specifically mandated within the Code.
(E)   The ICC International Fire Code, edition 2021, is hereby adopted, as amended by the City of Aledo. Compliance with the Code shall be required for all items regulated by the Code and where compliance is specifically required by the Code.
(F)   The ICC International Fuel Gas Code, edition 2021, is hereby adopted, as amended by the City of Aledo. Compliance with the Code shall be required for all items regulated by the Code and where compliance is specifically required by the Code.
(G)   The ICC International Mechanical Code, edition 2021, is hereby adopted, as amended by the City of Aledo. Compliance with the Code shall be required for all items regulated by the Code and where compliance is specifically required by the Code.
(H)   The ICC International Swimming Pool and Spa Code, edition 2021, is hereby adopted, as amended by the City of Aledo. Compliance with the Code shall be required for all items regulated by the Code and where compliance is specifically required by the Code.
(I)   The NFPA National Electrical Code, edition 2020, is hereby adopted, as amended by the City of Aledo. Compliance with the Code shall be required for all items regulated by the Code and where compliance is specifically required by the Code.
(J)   The Illinois Accessibility Code, edition 2018, is hereby adopted. Compliance with the Code shall be required for all items regulated by the Code and where compliance is specifically required by the Code.
(K)   The State of Illinois Plumbing Code is hereby adopted, as amended by the City of Aledo. Compliance with the Code shall be required for all items regulated by same and where specifically mandated within the Code
(L)   All of the above Codes are adopted by reference and shall be enforceable as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed herein.
(M)   Wherever a requirement of the Code conflicts with a written practice, policy or procedure adopted by the City Council, the adopted practice, policy or procedure shall prevail.
 
Section 3 . Title 4, Chapter 1, Section 2 of the Aledo City Code is hereby deleted in its entirety and replaced as follows:
4-1-2: AMENDMENTS:
 
   (A)   General Provisions:
       1.   All Adopted Codes:
(a)    Throughout all adopted codes, wherever the words [name of jurisdiction] appear, insert "the city of Aledo".
 
(b)   Throughout all adopted codes, wherever fee refunds are mentioned, the value "80%" shall be inserted in the appropriate place.
2.   International Residential Code: All references to "international residential code" shall be interpreted to mean the 2021 international residential code, as amended herein.
3.   International Building Code: All references to "international building code" or "IBC" shall be interpreted to mean the 2021 international building code, as amended herein.
4.   International Property Maintenance Code: All references to "international property maintenance code" or "IPMC" shall be interpreted to mean the 2021 international property maintenance code, as amended herein.
5.   International Fuel Gas Code: All references to "international fuel gas code" shall be interpreted to mean the 2021 international fuel gas code, as amended herein.
6. International Mechanical Code: All references to "international mechanical code" shall be interpreted to mean the 2021 international mechanical code, as amended herein.
7. International Swimming Pool and Spa Code: All references to "international swimming pool and spa code" shall be interpreted to mean the 2021 international swimming pool and spa code, as amended herein.
8. International Electrical Code: All references to "international electrical code" shall be interpreted to mean the 2020 NFPA 70 national electrical code as amended herein.
9.   International Plumbing Code: All references to "international plumbing code" shall be interpreted to mean the Illinois plumbing code as amended and adopted by the city of Aledo. Throughout, replace all references to specific plumbing matters with the applicable portions of the amended Illinois plumbing code unless explicitly stated otherwise by this or other ordinances of this jurisdiction.
 
10.   Accessibility: All accessibility requirements are to include the provisions of the Illinois accessibility code. In the event of conflicting requirements, provisions of the Illinois accessibility code shall prevail.
(B) Residential Code
 
The International Residential Code, 2021 Edition, and all appendices, unless deleted, published therewith, as published by the International Code Council, is hereby adopted by reference as the “Aledo Residential Code.” Three copies of such Code shall be kept on file in the city clerk’s office for inspection and shall remain on file therein for such purposes. The following sections of the International Residential Code, 2021 edition, are hereby revised as follows:
 
Section R101.1 Title.
Insert “the City of Aledo” for [NAME OF JURISDICTION]
Section R102.5 Appendices.
Delete entire section and replace with:
Section R102.5 Appendices.
The following appendices are hereby adopted: AB, AC, AD, AE, AF, AG, AH,AI, AJ, AM, AT, AQ, AW. Appendices not named herein do not apply.”
   Section R103 Department of Building Safety.
Change “Department of Building Safety” to “code administration department
   Section R103.1 Creation of enforcement agency.
Delete entire section and replace with:
R103.1 Enforcement agency. The building division is responsible for enforcing the provisions of this code. The official in charge of the building division shall be known as the building official. Throughout this and all referenced codes and ordinances, the executive official in charge, variously referred to as the chief building inspector, code official, and similar items, shall be interpreted to mean the building official.”
   Section 105.2 Work exempt from permit.
Amend Exemption 1 under “Building” by changing “200 square feet” to “120 square feet.”
 
 
   Section R112 Board of Appeals.
Delete entire section and replace with:
“Section R112 Board of Appeals. “The Aledo code committee shall be charged with the responsibilities of a building board of appeals. The committee's duties in this regard shall be limited to hearing and ruling upon whether the code official has correctly interpreted and applied a particular code or city ordinance having to do with the building codes. The committee shall have no authority to waive or amend the code, change or set policy or provide variances.’
Table R301.2(1) Climatic and Geographic Design Criteria.
Delete table and replace with:

Section R302.13 Fire Protection of floors.
Delete entire section.
Section R305.1.1 Basements. (Ceiling Height)
Delete the Exception in its entirety and replace with:
Exceptions:
1.   Beams, girders, ducts or other obstructions may project to within 6 feet 4 inches (1931 mm) of the finished floor.
2.   Conversions of attics and basements of a group R-3 occupancy utilized as a single-family dwelling unit shall have a ceiling height of not less than 6 feet 8 inches (2032 mm). Ductwork projections may be lower than this if located against partition walls. Doorway heights must be at least 6 feet 4 inches (1931 mm).”
Section R309.5 Fire sprinklers.
Delete entire “Section R309.5 Fire sprinklers” and all references thereto and replace with one new Section R309.5:
 
“R309.5 Opening Protection. Openings from a private garage directly into a room used for sleeping purposes shall not be permitted. Other openings between the garage and residence shall be equipped with self-closing, tight fitting solid wood doors not less than 1-3/8 inches (35mm) in thickness, solid or honeycomb steel doors not less than 1-3/8 inches (35 mm) in thickness, or 20-minute fire rated doors.”
 
Section R310.1 Emergency Escape and Rescue Opening.
 
Add: Where basements contain one or more sleeping rooms, emergency egress and rescue openings shall be located in each sleeping room, but shall not be required in adjoining areas of the basement when so provided.
Section R311.7 Stairways.
Delete: All Exceptions
Section R313 Automatic Fire Sprinkler Systems.
Delete entire section.
Section R314 Smoke Alarms
Add one new subsection:
R314.2.2 Alterations, repairs and additions. When interior alterations, repairs or additions requiring a permit occur, or when one or more sleeping rooms are added or created in existing dwellings, the individual dwelling unit shall be provided with smoke alarms located as required for new dwellings.
 
Exceptions:
3.   Smoke alarms in existing areas shall not be required to be interconnected and hard wired where the alterations or repairs do not result in the removal of interior wall or ceiling finishes exposing the structure.
4.   Repairs to the exterior surfaces of dwellings are exempt from the requirements of this section.”
 
Sections R403 Footings and R404 Foundation and Retaining Walls.  
Delete Tables R403.1(1)–R403.1(3), R403.4, R404.1.1(1), R404.1.1(2), R404.1.1(3), R404.1.1(4), R404.1.2(2), R404.1.2(3), R404.1.2(4), R404.1.2(5), R404.1.1.2(6), R404.1.2(7), R404.1.2(8) and R404.1.2(9) and all references thereto and replace with the following Table R403.1 and notes:

  Notes:
       (1)   Foundations may support a roof in addition to the stipulated number of floors. Foundations' supporting roofs only shall be as required for supporting one floor. Footings shall contain a minimum of two number 4 reinforcement bars, and have a minimum compressive strength of 2,500 pounds per square inch at 28 days.
       (2)    A one-story detached wood frame building used for a private garage and accessory to a single-family residential use and not exceeding 720 square feet in floor area, with no side dimension longer than 30 feet, and no wall height taller than 10 feet, and no more than 3 courses of masonry block, located on undisturbed soil, may be constructed with a floating slab. This slab shall be a minimum of 4 inches thick, air-entrained concrete having a minimum compressive strength at 28 days of not less than 3,000 pounds per square inch, reinforced with a 21-pound wire mesh, and having a 12-inch thick by 12-inch wide perimeter reinforced with no less than two number 4 reinforcement bars shall be installed within the perimeter beam. This slab shall be continuously poured with no cold joints.
       (3)   Buildings and portions of buildings containing mechanical installations and connected to underground utilities shall be supported on a continuous, frost-free foundation capable of resisting the movement of the slab-on-grade.
       (4)   Cast-in-place concrete foundation walls shall be air-entrained concrete having a minimum compressive strength at 28 days of not less than 3,000 pounds per square inch.
       (5)   Foundation walls shall be a minimum of 7½ inches thick with no less than three number 4 reinforcement bars placed horizontally at the center of the wall, with one bar located near the top, one bar located near the mid-height, and one bar located near the bottom.”
New Section R403.1.1.1 Footing requirements for uncovered decks. 
All decks shall have a minimum footing size of 12 inches in diameter with 42 inches in depth.
New Section R403.1.1.2 Footing requirements for covered decks and room additions. 
All elevated and covered decks, screened rooms, three and four-season rooms, and room additions shall comply with one of the following footing types:
1.   Pier footings were designed by a licensed design professional and submitted with stamped and signed plans or 24-inch diameter or 42-inches deep pier footing as approved by Building Official.
 
2.   12-inch wide by 42-inch deep trench footing with 2 number 4 rebar horizontally, one top and one bottom with minimum 3 inches of concrete coverage.
 
3.   Spread footing sized with reinforcement per Table R403.1 with a minimum 8-inch masonry or concrete foundation wall.
 
Section R403.1.4.1 Frost protection.
Exception 1. Detached garages - remove 600 square feet and change to 720 square feet.
Section R403.1.6 Foundation anchorage.
Add: “Wood sill plates and wood walls supported directly on continuous foundations shall be anchored to the foundation in accordance with this section. Wood sole plates shall not be encased or embedded in concrete.”
Section R404.1.3 Concrete foundation walls.
Change: “Concreted foundation walls that support light-frame walls shall be designed and constructed in accordance with the provisions of this section. ACI318, ACI 332, or PCA 100, or a method that meets standard practice for the jurisdiction pre- approved by the current Building Official.”
Section R407.1 Wood column protection.
Change: “Wood columns shall be protected against decay as set forth in Section R317, and shall not be encased or embedded in concrete.”
Table R503.2.1.1(1).
Delete the first three rows in the table and remove all references for the use of 3/8"sheathing for floor or roof construction.
Section R507.1 Decks.
Add: “or a method that meets standard practice for the jurisdiction pre-approved by the current Building Official.”
Section R507.3.1 Minimum Footing Size.
  Add at the end of the sentence: “But not less than 12 inches in diameter.”

At the beginning of the chapter, after ENERGY EFFICIENCY and before “SECTION N1101”, add:
“For Information only. Compliance with provisions of this chapter is not required by the City of Aledo.
 
 
Compliance with the current edition of the International Energy Conservation Code (IECC) adopted by the State of Illinois is required.”
 
Part VII Plumbing.
 
Delete all contents of Part VII “Plumbing” (Chapters 25-33) and replace with: “Refer to the Illinois Plumbing Code with City of Aledo amendments”
 
Section P2904 Dwelling Unit Fire Sprinkler Systems.
Delete entire section.
 
Part VIII Electrical
Delete all contents of Part VIII “Electrical” (Chapters 34-43) and replace with: “Refer to the NFPA 70 National Electric Code, as adopted with City of Aledo amendments.
 
(C) Building Code
The International Building Code, 2021 Edition, and all appendices, unless deleted, published therewith, as published by the International Code Council, is hereby adopted by reference as the “Aledo Building Code.” Three copies of such Code shall be kept on file in the city clerk’s office for inspection and shall remain on file therein for such purposes. The following sections of the International Building Code, 2021 edition, are hereby revised as follows:
 
Section 101.1 Title.
Insert “the City of Aledo” for [name of jurisdiction].
Section 101.2 Scope:

Section 108.2 Schedule of Permit Fees.

Section 113 Means of Appeal.
Delete all subsections and replace with:

Section 202 Definitions.
  Amend as follows:
PERSON. An individual or such individual’s heirs, executors, administrators or assigns; and includes and extends to associations, clubs, societies, firms, partnerships, and bodies politic and corporate or its or their successors or assigns; or the agent of any of the aforesaid.”
Section 1011.11 Handrails.
 Add Exception:
6.   Handrails within a dwelling or serving an individual dwelling unit may have one (1) offset or interruption per flight of stairs, not both, of a maximum of six (6) inches in total length and shall be considered for the purpose of this code to be continuous.
Section 1101.2 Design.
Change "Buildings and facilities shall be designed and constructed to be accessible in accordance with this code and ICC A117.1."
To read: "Buildings and facilities shall be designed and constructed to be accessible in accordance with this code, the latest version of Illinois accessibility code, and ICC/ANSI A117.1."
 
 
Section 1208.2 Minimum ceiling heights.  
Add one new Exception 5:
"5. Conversions of attics and basements of a group R-3 occupancy utilized as a single family dwelling unit shall have a ceiling height of not less than 6 feet and 8 inches. Chapter 13 Energy Efficiency.  
  Delete entire chapter and replace with:
"Chapter 13 Energy Efficiency. Designers and builders are required to design and construct buildings in accordance with the current International Energy Conservation Code" adopted by the State of Illinois."
Section 1608.1 General.  
   Add:
  "Note: All snow loads shall be based on a minimum roof snow load (ps) of 30 pounds per square foot, except that calculations for additional snowdrift loads shall be based on a ground snow load pg = 25 pounds per square foot."
Section 1809.5 Frost protection.
Change: "1. Extending below the frost line of the locality" to "1. Extending below the 42-inch frost line"

The International Property Maintenance Code, 2021 Edition, and all appendices, unless deleted, published therewith, as published by the International Code Council is hereby adopted by reference as the “Aledo Property Maintenance Code.” Three copies of such Code shall be kept on file in the city clerk's office for inspection and shall remain on file therein for such purpose. The following sections of the International Property Maintenance Code, 2021 edition, are hereby revised as follows:
   101.1 Title.
Insert “the City of Aledo, IL” for [NAME OF JURISDICTION].

Delete International Zoning Code  and replace with “Aledo, IL Code of Ordinances.”
102.7 Referenced codes and standards.
Delete entire section and replace with:

“The codes and standards referenced in this code shall be those that are listed in the Aledo, IL Code of Ordinances. Where differences occur between provisions of this code and the referenced code or standards, the most restrictive provisions shall apply.”
103.1 Creation of agency
Delete entire section and replace with:
“103.1 Enforcement agency. The building division is responsible for enforcing the provisions of this code. The official in charge of the building division shall be known as the code official”
 
202 GENERAL DEFINITIONS.
            Add the following definitions:
BUILDING CODE. The International Building Code and International Residential Code as adopted by the City of Aledo.
DANGEROUS. An unfit building where conditions or defects exist within the structure to the extent that the life, health, property or safety of the public or its occupants are imminently endangered and immediate corrective action is necessary.
HOT WATER. Water supplied to plumbing fixtures at 115°F (45°C).
SUBSTANDARD. A structure that fails in any respect to comply with the Aledo, IL Code of Ordinances. Failure to correct such non-compliance may result in such building becoming an unfit building.
UNFIT. A substandard building where conditions or defects exist to the extent that the life, health, property or safety of the public or its occupants may be endangered and action within a certain time period is required. Failure to correct such conditions or defects within the time period may cause an unfit building to become a dangerous building.”
            IMMINENT DANGER. Add the following sentence to the end of the definition:
“A severe condition(s) that could endanger the life, limb, health, property, safety or welfare of the public or the occupants.”
 
 
302.1 Sanitation.
Add "In addition to the fines provided for a violation of this section, the city may, after the responsible party has failed to comply with the notice of violation, perform such work so as to restore the property to a clean, safe and sanitary condition. Such work shall be at cost to the owner. In performing such nuisance abatement, the city shall follow all legal requirements."
302.4 Weeds.
Insert “8 inches” in space indicated.
302.7 Accessory Structures.
Delete entire section and replace with:
302.7 Accessory Structures.
“All accessory structures, including detached garages, fences, walls and temporary structures, shall be maintained structurally sound and in good repair.
302.7.1 Minor Temporary Accessory Structures.  Temporary canopies, carports and similar portable and premanufactured structures made of a support structure and enclosed or covered by fabric, canvas, nylon, vinyl, plastic, or other non-rigid material and equal to or less than 120 square feet may be placed, maintained, and installed in the City as long as said structure is securely anchored, free of tears, rips and other defects, and meets all setback requirements of an accessory structure.
302.7.2 Major Temporary Accessory Structures.  Temporary canopies, carports and similar portable and premanufactured structures made of a support structure and enclosed or covered by fabric, canvas, nylon, vinyl, plastic, or other non-rigid material and greater than 120 square feet may be placed, maintained, and installed in the City as long as said structure complies with all building and zoning codes that would apply as if it were a permanent accessory structure.”
302.8 Motor Vehicles.
        Delete entire section and replace with:
No inoperative or unlicensed motor vehicle shall be parked, kept or stored on any premises and no vehicle shall at any time be in a state of major disassembly, disrepair, or in the process of being stripped or dismantled. Painting of vehicles is prohibited unless conducted inside an approved spray booth.
Exception: Vehicles belonging to the lawful occupant of the property may be kept in an accessory building properly and lawfully constructed and zoned for such use, provided such storage is safe and sanitary, regardless of its operative or license status. A motor vehicle may undergo major overhaul provided such work is permitted by the zoning ordinance and performed inside a structure that is designed and approved for such purpose.
 
In addition to the fines provided for a violation of this section, the city may, after the responsible party has failed to comply with the notice of violation, remove the offending vehicle from the property at cost to the owner. In performing such nuisance abatement, the city shall follow all legal requirements."
302.10 Furniture.
Add one new section to read as follows:
“302.10 Furniture.  Only furniture and equipment designed and intended for outdoor use and able to withstand outdoor elements and weather conditions shall be permitted to be kept in exterior property areas, including unenclosed porches, patios and decks.”
304.14 Insect Screens. 
Insert : “During the period from April 15 to November 15”
307.1 Handrails and Guardrails.
Delete the “Exception” and replace with:
“Exception:  Every interior and exterior handrail and guardrail shall be firmly fastened and capable of resisting an imposed load of fifty (50) pounds in any one direction. Replacement of either shall be in compliance with the current adopted building code. The code official shall have the authority to allow non-compliance replacement based upon historical or other integral considerations.”
503.4 Floor surface.
 
Delete entire section and replace with:
“503.4 Floor surface.  Every bathroom and kitchen floor surface shall be constructed and maintained so as to be impervious to water. All floor surfaces shall be easily cleanable.”
 
505.4 Water Heating Facilities.
 
Delete entire section and replace with:
 
"Water heating facilities shall be properly installed, maintained and capable of providing an adequate amount of water to be drawn at every required sink, lavatory, bathtub, shower, and laundry facility at temperatures specified in the Illinois plumbing code. Storage-type water heaters shall have the following minimum capacities:
           1. Single unit - 30 gallons.
           2. Duplex unit with shared water heater - 40 gallons.
           3. Triplex unit with shared water heater - 50 gallons.
Other means of supplying hot water, such as demand-type water heaters, must supply at least the equivalent amount of heated water in wintertime conditions.
A gas-burning water heater shall not be located in any bathroom, toilet room, bedroom, or other occupied room normally kept closed, unless adequate combustion air is provided."
602.3 Heat supply.
 
Insert “October 1 to May 15”  
 
602.4 Occupiable work spaces.
 
Delete entire section and replace with:
“602.4 Occupiable work spaces.  Indoor occupiable work spaces shall be supplied with heat during the period from October 1 to May 15 to maintain a minimum temperature of 65°F (18°C) during the period the spaces are occupied.
Exceptions: Processing, storage and operation areas that require cooling or special temperature conditions. Areas in which persons are primarily engaged in vigorous physical activities.”
 
605.2 Receptacles.
 
Delete entire section and replace with:
“605.2 Receptacles.  Every habitable space in a dwelling unit shall contain at least two (2) separate and remote receptacles. Every laundry area shall contain at least one (1) grounded-type receptacle or a receptacle with a ground fault circuit interrupter. At least one (1) ground fault circuit interrupter (GFCI) shall be installed in every bathroom adjacent to the basin location. All residential bathroom receptacles are to be GFCI protected.”
 
SECTION 606. ELEVATORS, ESCALATORS AND DUMBWAITERS.
 
Delete entire section and replace with:
“SECTION 606. ELEVATORS, ESCALATORS AND DUMBWAITERS.  Refer to applicable State of Illinois laws.”
703.4 Opening protectives.
Amend by adding a second paragraph:
“All apartments, rooming houses or rooming units exiting into a common hallway shall have a minimum 1-3/8” solid core or equivalent self-closing doors equipped with latches and having a minimum fire resistance rating of twenty (20) minutes.”
 
Section 705 CARBON MONOXIDE ALARM DETECTORS.
 
(a)   Definitions. As used in this section, the following terms shall have the meanings ascribed to them:
(1)   Approved Carbon Monoxide Alarm or Alarm means a carbon monoxide alarm that complies with all the requirements of the rules and regulations of the Illinois State Fire Marshal, bears the label of a nationally recognized testing laboratory, and complies with the most recent standards of the Underwriters Laboratories or the Canadian Standard Association.
(2)   Dwelling Unit means a room or suite of rooms used for human habitation, and includes a single-family residence as well as each living unit of a multi-family residence and each living unit in a mixed-use building.
(b)   Carbon Monoxide Detector.
(1)   Every dwelling unit shall be equipped with at least one approved carbon monoxide alarm in an operating condition within fifteen (15) feet of every room used for sleeping purposes. The carbon monoxide alarm may be combined with smoke detecting devices provided that the combined unit complies with the respective provisions of state rules and regulations relating to both smoke detecting devices and carbon monoxide alarms and provided that the combined unit emits an alarm in a manner that clearly differentiates the hazard.
(2)   Every structure that contains more than one (1) dwelling unit shall contain at least one (1) approved carbon monoxide alarm in operating condition within fifteen (15) feet of every room used for sleeping purposes.
(3)   It is the responsibility of the owner of a structure to supply and install all required alarms. It is the responsibility of a tenant to test and to provide general maintenance for the alarms within the tenant's dwelling unit or rooming unit, and to notify the owner or the authorized agent of the owner in writing of any deficiencies that the tenant cannot correct. The owner is responsible for providing one (1) tenant per dwelling unit with written information regarding alarm testing and maintenance.
The tenant is responsible for replacement of any required batteries in the carbon monoxide alarms in the tenant’s dwelling unit, except that the owner shall ensure that the batteries are in operating condition at the time the tenant takes possession of the dwelling unit. The tenant shall provide the owner or the authorized agent of the owner with access to the dwelling unit to correct any deficiencies in the carbon monoxide alarm that have been reported in writing to the owner or the authorized agent of the owner.
(4)   The carbon monoxide alarms required under this Act may be either battery powered, plug-in with battery back-up, or wired into the structure’s AC power line with secondary battery back-up.
(c)   Violation.
(1)   Willful failure to install or maintain in operating condition any carbon monoxide alarm required by this section is considered a violation.
(2)   Tampering with, removing, destroying, disconnecting, or removing the batteries from any installed carbon monoxide alarm, except in the course of inspection, maintenance, or replacement of the alarm, is considered a violation.
(3)   Any person violating any of the provisions of this section shall be subject to a fine in accordance with the general penalty provisions of the Aledo Code of Ordinances.
(d)   Exemptions. The following residential units shall not require carbon monoxide detectors:
(1)   A residential unit in a building that: (i) does not rely on combustion of fossil fuel for heat, ventilation, or hot water; (ii) is not connected in any way to a garage; and (iii) is not sufficiently close to any ventilated source of carbon monoxide, as determined by the City’s building official, to receive carbon monoxide from that source.
(2)   A residential unit that is not sufficiently close to any source of carbon monoxide from that source, as determined by the City’s building official.
 
(E) Mechanical Code
 
The International Mechanical Code, 2021 Edition, and all appendices, unless deleted, published therewith, as published by the International Code Council, is hereby adopted by reference as the “Aledo Mechanical Code.” Three copies of such Code shall be kept on file in the city clerk’s office for inspection and shall remain on file therein for such purposes. The following sections of the International Mechanical Code, 2021 edition, are hereby revised as follows:
Section 101.1 Title.
Insert “the City of Aledo, IL” for [NAME OF JURISDICTION].
Section 101.2.1 Appendices.
The following appendix is hereby adopted: “Appendix A – Combustion Air Openings and Chimney Connector Pass- throughs.” Appendices not named herein do not apply.”
 
Section 103.1 Creation of agency.

The International Fuel Gas Code, 2021 Edition, and all appendices, unless deleted, published therewith, as published by the International Code Council, is hereby adopted by reference as the “Aledo Fuel Gas Code.” Three copies of such Code shall be kept on file in the city clerk’s office for inspection and shall remain on file therein for such purposes. The following sections of the International Fuel Gase Code, 2021 edition, are hereby revised as follows:
 
Section 101.1 Title.
 
Insert “the City of Aledo, IL” for [NAME OF JURISDICTION].
 
Section 101.3 Appendices.
 
The following appendices are hereby adopted: A, B, C and D. Appendices not named herein do not apply.”
 
Section 103 (IFGC) Department of Inspection.      
Change “Department of Inspection” to “building division”
Section 103.1 General.  
Replace entire section with:
103.1 General. The building division is responsible for enforcing the provisions of this code. The official in charge of the building division shall be known as the building official. References to ‘code official’ throughout this code shall be construed to mean ‘building official or building official’s designee’.
Section 301 (IFGC) General.
          Add one new section:
"301.1.1.2 L-P Gas Systems. Liquefied Petroleum Gas systems shall not be used unless jointly approved by the fire marshal and the building official."
Section 403.3.3 Copper and copper alloy.
Delete entire section and replace with:
"Section 403.3.3 Copper and copper alloy. Copper and copper alloy pipe shall not be used."
Section 403.4.3 Copper tubing.  
Delete entire section and replace with:
"Section 403.4.3 Copper and copper alloy tubing. Copper and copper alloy tubing shall not be used."
Section 403.10 Metallic piping joints and fittings.
Insert:
5.   The type of piping joint used shall be suitable for the pressure-temperature conditions and shall be selected giving consideration to joint tightness and mechanical strength under the service conditions. The joint shall be able to sustain the maximum end force caused by the internal pressure and any additional forces caused by temperature expansion or contraction, vibration, fatigue or the weight of the pipe and its contents.
Section 406 (IFGS) Inspection, Testing and Purging.
Delete entire section and replace with:
             "Section 406.4.1 Test Pressure.
All tests are to be witnessed by the building official or his designee. A pressure gauge and bleeder valve must be on the system during this test in a location readily available to the person conducting the inspection."
 
(G) Electrical Code
The NFPA 70 National Electrical Code, 2020 Edition, as published by the National Fire Protection Association is hereby adopted by reference as the “Aledo Electrical Code.” Three copies of such Code shall be kept on file in the city clerk’s office for inspection and shall remain on file therein for such purposes. The following sections of the International Electrical Code, 2021 edition, are hereby revised as follows:
 
   Article 210
   Section 210.8 (A) Dwelling Units.
   Delete wording “through 250-volt”
   
Section 210.8(A)(5)
Add two additional exceptions:
All 125-volt receptacles in a finished basement shall not be required to have Ground-Fault Circuit-Interrupter Protection for Personnel.
Sump pumps shall not be required to have Ground-Fault Circuit-Interrupter protection installed for the receptacle as long as this receptacle in a Simplex Style (Single) receptacle
Section 210.8(B) Other Than Dwelling Units. 
Delete entire Section 210.8(B) 2020 NEC and replace with:
“Section 210.8(B) Other than Dwelling Units with 2011 NEC.”
          Add one additional exception before the current exceptions:
"Exception No. 1 to (2): Commercial (non-residential) refrigerators and freezers will not be required to have ground-fault-circuit-interrupter protection if the receptacle is a Simplex Style (Single) receptacle."
Delete Section 210.8(F).
Section 210.52(C)(2) Island and Peninsular Countertops and Work Surface. 
Delete Section 210.52(C)(2) of the 2020 NEC.
Article 230 Services.
Add one new section:
            "Section 230.45 Service-Entrance Conductors Inside Structures.
When located inside a structure, non-fused service entrance conductors shall not extend more than ten (10) feet inside the structure unless the code official permits the ten (10) feet to be increased."
Section 230.67 Surge Protection. 
Delete Section 230.67.
Article 310 Conductors for General Wiring.
Section 310.3(A) 
Change 14 AWG copper to 12 AWG copper. Change 12 AWG aluminum to 10 AWG aluminum.
Article 334 Nonmetallic-Sheathed Cable: Type NM and NMC.
Section 334.10 Delete 334.10(3), (4), and (5).
Section 334.10(3) Add - Type NM and NMC Cable can be used for the wiring of motels, hotels and assisted care facilities of type III, IV and V construction where the cable is concealed within walls, floors, and ceilings that provide a thermal barrier of material that has at least a 15-minute finish rating as identified in listings of fire-rated assemblies.
(H) Swimming Pool & Spa Code
The International Swimming Pool and Spa Code, 2021 Edition, and all appendices, unless deleted, published therewith, as published by the International Code Council is hereby adopted by reference as the “Aledo Property Maintenance Code.” Three copies of such Code shall be kept on file in the city clerk's office for inspection and shall remain on file therein for such purpose. The following sections of the International Swimming Pool and Spa Code, 2021 edition, are hereby revised as follows:
 
101.1 Title.
Insert “the City of Aledo, IL” for [NAME OF JURISDICTION].
103.1 Creation of agency
Delete entire section and replace with:

Section 4 .   Nothing in this ordinance, or in any of the codes hereby adopted shall be construed to affect any suit or proceeding pending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any ordinance repealed or replaced upon the adoption of this ordinance, nor shall any legal right or remedy of any character be lost, impaired or affected by this ordinance.
Section 5.   This Ordinance is hereby ordered to be published in pamphlet form by the Aledo City Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.
Section 6.   This Ordinance is in addition to all other ordinances on the subject and shall be construed therewith excepting as to that part in direct conflict with any other ordinance, and in the event of such conflict, the provisions hereof shall govern.
Section 7.   This Ordinance shall be in full force and effect from and after its passage, approval and ten (10) day period of publication in the manner provided by law.
