8-12-4: CONDITIONS FOR GRANTING PERMIT:
The City Clerk shall, on receiving petition indicated in section 8-12-3 of this chapter, transmit same to Director for verification of site and feasibility. The Director, after such verification shall, in writing, approve said petition and return same to City Clerk who will cause petitioner to be notified that petition is granted subject to the following conditions:
   (A)   An improved street or sidewalk shall be replaced or reconstructed and any excavation filled under the direction of the Superintendent so that the same shall be in as good and serviceable condition as it was prior to being disturbed. (Ord. 13/75, 11-17-1975)
   (B)   All repairs in traveled portion of any street and at least three feet (3') beyond the curb or ditch line shall contain suitable material to within six inches (6") of the surface and the balance shall consist of the same material as removed. All materials used in repairing any street or side portion thereof as provided and required above shall be properly compacted and all reconstruction and repair work on any street or side portion thereof shall be done in a workmanlike manner subject to the direction and approval of the Director of Public Works and Utilities.    (C)   All such replacement, reconstruction and filling shall be done under the direction of and subject to the approval of the Director, and the materials used therein shall be such as said Director shall designate. (Ord. 13/75, 11-17-1975)
   (D)   Petitioner shall guarantee the entire expense of the replacement, reconstruction or filling of any work permitted hereunder by depositing with the Clerk, in cash or its equivalent, any sum required by the Director at the time such permit is granted, but not less than the sum pursuant to title 13, "Schedule Of Fees", of this Code, and if said Director fails to designate any amount at the time such permit is acted upon, the deposit made with the Clerk at the time such petition is filed shall be deemed sufficient.    (E)   Upon the completion of the work and the written approval thereof by the Director, the Clerk shall deduct from the deposited guarantee, the costs and expenses of the City of such replacement, reconstruction or filling not otherwise paid by petitioner including an amount for the time spent by the City employees in inspecting, supervising or working on such proposed work at the hourly rate then paid such City employees by the City and repay the balance, if any, to the petitioner. All amounts so deducted for costs and expenses shall be paid into the General Corporate Fund of the City. (Ord. 13/75, 11-17-1975)
