§ 35.01 GENERAL PURCHASING RULES.
   The following purchasing rules shall apply to the Purchasing Agent, as defined in § 35.03, when making purchases for the town.
   (A)   If the purchase of supplies is reasonably expected to be:
      (1)   Less than $50,000, the Purchasing Agent:
         (a)   May purchase the supplies on the open market; and
         (b)   Is not required to invite or receive quotes or bids;
      (2)   At least $50,000, and not more than $150,000, the Purchasing Agent:
         (a)   May purchase supplies under this section by inviting quotes from at least three persons known to deal in the lines or classes of supplies to be purchased;
         (b)   Shall mail an invitation to quote to the persons described in division (A)(2)(a) at least
seven calendar days before the time fixed for receiving quotes;
         (c)   Shall award a contract to the lowest responsible and responsive offeror for each line or class of supplies required if a satisfactory quote is received;
         (d)   May reject all quotes; and
         (e)   May make a special purchase pursuant to the special purchasing methods described in I.C. 5-22-10-1 et seq. in the event a quote is not received from a responsible and responsive offeror.
      (3)   More than $150,000, the Purchasing Agent shall follow the procedure described in I.C. 5-22-7-1 et seq. in awarding a contract for supplies, unless another purchasing method is required or authorized by I.C. Title 5, Article 22.
   (B)   Services may be purchased in a manner deemed reasonable under the circumstances.
