§ 193.091 VACATION OF PUBLIC WAY OR PLACE; PLATTED EASEMENTS.
   (A)   (1)   Pursuant to I.C. 36-7-3-12, persons who do the following may file a petition for vacation all or part of said public way or place with the Town Council:
         (a)   Own or are interested in any lots or parts of lots; and
         (b)   Want to vacate all or part of a public way or public place in or contiguous to those lots or parts of lots.
      (2)   The petition shall:
         (a)   State the circumstances of the case;
         (b)   Specifically describe the property proposed to be vacated; and
         (c)   Give the names and addresses of all owners of land that abuts the property proposed to be vacated.
   (B)   (1)   The Town Council has exclusive control and jurisdiction over the vacation of any public way or place.
      (2)   The procedures to be followed by the Town Council in the vacation of a public way or place shall those outlined in I.C. 36-7-3-12.
   (C)   Pursuant to I.C. 36-7-3-16(a), platted easements shall be vacated in the same manner as public ways and public places.
   (D)   If a petition requesting to vacate all or part of a public way, public place or platted easement is filed in connection with the vacation of all or part of a plat, the petition to vacate all or part of a public way, public place or platted easement shall be considered, and a disposition made, by the Town Council prior to the Plan Commission’s consideration of any petition to vacate all or part of the plat.
