§ 99.03 ENFORCEMENT.
   (A)   (1)   Sworn officers are hereby empowered, in accordance with state statute, to take all appropriate action with regard to violations of §§ 99.20 through 99.29 of this chapter, including, where authorized by state statute, the arrangement for capture and confinement of animals deemed to be a public nuisance.
      (2)   Further, sworn officers shall be empowered to issue written warnings and citations to owners of animals in violation of this subchapter.
      (3)   It is the intent and recommendation of the Town Council that unless extenuating or grievous circumstances exist in connection with a first violation, that the owners of such animals be issued a written warning upon a determination by the sworn officer that a violation has occurred for the first time.
   (B)   Nothing in this chapter shall be interpreted to conflict with any state statutes addressing animal control, nor shall this chapter be interpreted as relieving any animal owner from liability for any and all damages and/or fines under state statute or common law for any improper or illegal activity engaged in by his or her animals.
