For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CABLE TELEVISION SYSTEM or SYSTEM. Any system which receives and amplifies signals broadcast by one or more television and/or radio stations and which transmits programming originated by the system itself or by another party, and distributes such signals and programming by wire, cable, satellite or other means to persons who subscribe to such service; provided that, the same does not include microwave or other similar link-up. It is further provided that CABLE TELEVISION SYSTEM or SYSTEM does not include any similar system not requiring the use of public ways.
CLERK-TREASURER. The duly elected Clerk-Treasurer for the Town of Zionsville, Indiana.
COUNCIL. The Town Council for the Town of Zionsville.
FRANCHISE. The non-exclusive right to construct, operate and maintain a cable television.
GROSS REVENUES. The total amount of money received during the applicable calendar years by the operator for basic monthly service rates (not including premium service) paid by the subscriber, including, but not limited to, basic monthly service rates for police or fire alarm or other services not now included in § 111.15 of this chapter or any subsequent amendments thereto.
OPERATOR. The person awarded the cable television franchise under this chapter, the same being Omega of Zionsville Cable TV Company.
PERSON. Any person, firm, partnership, association, corporation or organization of any kind.
PUBLIC WAY. The surface and the area above and below the surface of any public street, highway, lane, alley, sidewalk, path, right-of-way or easements and any public utility, easements or rights-of-way dedicated generally for public utility uses.
SUBSCRIBER. Any person who contracts or agrees to purchase the regular subscriber service, pay television or any other service provided by the cable television system, including those persons who are given free service and use of the cable television system including anyone actually using such services.
TERRITORY. The area included within the corporate limits of the Town of Zionsville, Indiana.
TOWN. The Town of Zionsville, Indiana.
