§ 94.05 PERMITTED OPEN BURNING.
   The following open burning shall be permitted in the town, subject to the conditions in § 94.04 of this chapter:
   (A)   Open burning on a single-unit residential property, only during daylight hours and which shall be extinguished prior to sunset. Burning shall be permitted only in a non-combustible container that is sufficiently vented to induce adequate primary combustion, has enclosed sides, a bottom and a mesh covering with openings no larger than one-quarter inch square, and only clean wood products and paper are burned;
   (B)   Recreational or ceremonial fires, such as fires for scouting activities, and fires used for cooking purposes, such as camp fires, subject to the conditions in § 94.04 of this chapter and the following conditions:
      (1)   Only clean wood products, charcoal or clean petroleum products may be burned;
      (2)   The local Fire Department and Health Department must be notified at least 24 hours prior to any open burning where the size of the pile being burned is more than 125 cubic feet;
      (3)   Fires shall not be ignited prior to two hours before the recreational activity is to take place and shall be completely extinguished upon conclusion of the activity;
      (4)   The pile to be burned shall be less than 1,000 cubic feet and only one pile may be burned at a time; and
      (5)   Fires shall not take place within 500 feet of any fuel storage area or pipeline.
   (C)   Open burning, for the sole purpose of heating, using clean wood products or paper in non- combustible container that is sufficiently vented to induce adequate primary combustion, and has enclosed sides and a bottom, and a mesh covering with openings no larger than one-quarter inch square. This type of open burning shall be subject to the conditions in § 94.04 of this chapter and the following conditions:
      (1)   May only occur between October 1 and May 15; and
      (2)   Shall not be conducted for the purpose of disposal.
   (D)   Open burning with approval of the State Air Pollution Control Board or its designated agent, as provided in 326 I.A.C. 4-1-1, which includes burning for county highway roadside clearing, initial public right-of-way clearing, railroad tracks repair and maintenance, waste oil spillage, mission related activities on DNR-controlled properties, firefighter training, emergencies including spilled material or natural disasters clearing and natural growth for land use change or land management.
