Pursuant to I.C. 36-7-4-1325, the town acquires a lien against the real estate which is the subject of the traffic impact fee on the date the structural building permit is issued. Upon final adoption, this subchapter shall be recorded and, thereafter, it shall constitute constructive notice of the lien rights of the town. The town may, in its discretion, file a specific instrument setting forth its statutory lien rights with respect to a parcel of real estate which is the subject of an installment payment of a traffic impact fee, and such instrument shall constitute actual notice in addition to the constructive notice provided for by the recording of this subchapter.
