§ 53.17 REPAIR OR REPLACEMENT OF SIDEWALKS.
   (A)   The town shall repair or replace sidewalks based upon a survey of existing sidewalk conditions prepared by the town. The installation, repair, an/or replacement of sidewalks within the public rights-of-way of developed areas shall be the responsibility of the town.
   (B)   The conditions of existing sidewalks will be evaluated and ranked into one of four categories as set out in this section. Condition evaluation criteria shall include:
      (1)   ADA compliance;
      (2)   Construction material;
      (3)   General condition;
      (4)   Surface condition (i.e., spalling);
      (5)   Horizontal alignment;
      (6)   Cracking (i.e., surface, structural);
      (7)   Horizontal clearance;
      (8)   Vertical level differential(s);
      (9)   Vertical alignment;
      (10)   Heaving (frost or root);
      (11)   Vertical clearance; and
      (12)   Other defects.
   (C)   The survey shall, utilizing the criteria set forth above, rank existing sidewalk conditions as:
      (1)   Excellent;
      (2)   Good;
      (3)   Fair; or
      (4)   Poor.
   (D)   The survey shall further prioritize the repair or replacement of sidewalks into one of the following three categories:
      (1)   High-priority/short-term action;
      (2)   Mid-priority/mid-term action; or
      (3)   Low-priority/long-term action.
   (E)   The criteria to be utilized in the prioritization of sidewalk repair or replacement include the frequency of use of the sidewalk and proximity of the sidewalk to pedestrian traffic generators.
   (F)   The sidewalks chosen for repair or replacement shall be based upon their priority listing and condition rating, and shall be accomplished on an on-going, annual basis as budgeted by the Town Street Department and the Town Council.
   (G)   It is the intent of the town, through implementation of this policy, to accomplish substantial enhancement of the town’s sidewalk system in a cost effective manner. Therefore, sidewalk repair or replacement will be accomplished on a block-long basis wherever practical and appropriate. Isolated “spot repairs” will be conducted only in the case of an identified health and safety condition that mandates immediate site-specific remediation.
