§ 53.15 DEFINITIONS.
   For the purpose of this subchapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
   DEVELOPED AREAS. Any real estate containing existing development or improvements, or any platted real estate, whether or not containing existing development or improvements.
   OWNER. Any one or more of the following:
      (1)   The owner or owners in fee simple of a parcel of real estate, including the life tenant or tenants;
      (2)   The record owner or owners as reflected by the most current records of the County Auditor’s Office; or
      (3)   The purchaser or purchasers of such real estate under any contract for the conditional sale thereof.
   PATHWAY. A pedestrian walkway or bicycle way, as identified on the Pathway/Sidewalk Network Map of the town, dated December 1999, as may be amended from time to time.
   PERSON. Any individual, firm, partnership, association, corporation, business, trust, joint stock company, unincorporated organization, religious or charitable organization or any owner, person, persons or entities.
   PRIVATE PROPERTY. All real estate within the town, except real estate that is owned, leased, controlled or occupied by the state, the county or any departments or agencies of the town.
   RIGHT-OF-WAY, PUBLIC. Specific and particularly described strip of land, property or interest therein dedicated to and accepted by the municipality, county or state to be devoted to and subject to use by the general public for general transportation purposes or conveyance of utilities whether or not in actual fact improved or actually used for such purposes, as set forth in a written grant, declaration or conveyance that is recorded by the office of the County Recorder.
