(A) The town shall assess an availability fee of:
(1) Single-family dwelling unit: $4,000 for each single connection to the town’s sewer system; and
(2) All other uses (multi-family, commercial, industrial or public/semi-public): $4,000 for the first EDU and $2,000 for each additional EDU, as determined pursuant to § 52.045 of this chapter.
(B) If the structure or building to be connected has not yet been constructed, the availability fee shall be paid when a building permit for the structure or building is issued. The availability fee may be paid by any person having an interest in the real estate upon which the structure or building does or shall rest.
(C) The availability fee is non-refundable, unless by specific agreement between the town and the owner of the building or structure requesting to connect to the town’s sewer system. In addition, the availability fee shall apply to any connection to the town’s sewer system pursuant to § 52.050 of this chapter.
