(a) No person having charge of any motor vehicle shall perform repairs requiring the removal or installation of parts of such vehicle upon the public streets and alleys within the City, except that emergency repairs performed under circumstances which prevent the removal of such vehicle from the street or alley do not constitute a violation of this section.

(b) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
