(a) Subject to the system of preferences set forth herein, contracts for the purchase of all equipment, materials or supplies, and contracts for the provision of labor and construction services, shall be awarded to the lowest and best bidder.
(b) Prior to awarding a contract the City shall evaluate the bids received according to criteria and procedures contained in Section 189.02 and 189.03. Contracts that only involve the purchase of equipment, materials or supplies shall be awarded in accordance with the criteria and procedures set forth in Section 189.02. Contracts that involve the provisions of labor for construction, reconstruction, improvement, enlargement, alteration, repair, painting or decoration of a public improvement shall be awarded in accordance with the criteria and procedures set forth in Section 189.03. Contracts that involve both the purchase of equipment, materials or supplies as well as the provision of labor shall proceed under either Section but not both.
