(a) The proper City official is hereby authorized to accept requests from the general public for requests for hard fill material on a first come, first served basis, with the full right to accept or deny any such request as desired appropriate by the Public Service Director or his designee, based on material availability, site selection, and travel distance for disposal.
(b) The City shall, at its option, deliver unused fill material to a site requested and approved by the proper authority, or load a customer truck on the jobsite or at the 1084 Central Avenue Street Garage for such disposal. The City shall not perform any spreading, compacting or other construction activity on private property. It is wholly the property owner’s responsibility to follow City, County, State and Federal regulations applicable to acceptance of such materials, and each request shall require the property owner to sign an agreement for accepting the material and a waiver releasing the City from any consequences regarding liability.
