(a) Severability. If any provision of this chapter or its application is held invalid, such invalidity shall not affect other provisions or applications of this chapter which can be given effect without the invalid provision or application and to this end the provisions of this chapter are declared severable.
(b) Minimum Maintenance Requirement.
(1) The owner of an historic structure or any structure within an historic district, if such structure is vacant and uninhabited, shall provide sufficient maintenance and upkeep for such structure to ensure its perpetuation and to prevent its destruction by deterioration.
(2) The Historic Preservation Board on its own initiative may file a petition with the Division of Code Enforcement requesting that action be taken against any owner which in the opinion of the Board is in violation of minimum maintenance standards.
