1305.04 AMENDMENTS.
   The ICC International Property Maintenance Code 2021, as adopted herein is amended and changed in the following respects:
   (a)   102.3 Application of other codes shall be amended to read as follows: Repairs or additions to a structure, or changes of occupancy shall be done in accordance with the procedures and provisions of the codes mandated by the State of Ohio and the rules of the Ohio Board of Building Standards currently adopted which include the Ohio Building Code, the Residential Code of Ohio, the Ohio Fire Code and any and all International Codes and Standards specifically referenced by any one of the afore named Ohio Codes.
      1.   This amendment will apply to all sections and sub-sections where reference is made to an International Code.
   (b)   Section 302.1.1 under the heading of Exterior Property Areas shall be added to read as follows: No person in any Residential District as defined in Chapter 1137 of the Codified Ordinances of the City of Zanesville shall store, collect, park, leave, deposit, maintain, reserve, put aside for future use, permit, allow or suffer to remain in a yard, except in a completely enclosed building or structure, any lumber, equipment, or materials used in the construction trade, except those related to construction on the premises for which a current building permit has been issued and is posted.
   (c)   Section 302.1.2 under the heading of Exterior Property Areas shall be added to read as follows: Only furniture specifically designed for exterior use shall be permitted on porches, patios, decks or in yards or in yard structures.
Exception: Shall not apply to porches or decks completely enclosed for all weather use.
   (d)   Section 302.1.3 under the heading of Exterior Property Areas shall be added to read as follows: No bagged, boxed, or loose storage shall be permitted on porches or decks with the exception that trash storage containers may be kept on rear or interior side porches
   (e)   Section 302.1.4 under the heading of Exterior Property Areas shall be added to read as follows: No furniture, household appliances or plumbing fixtures may be used as part of any landscaping display unless approval is granted by the Zoning Administrator or the designated agent for the City of Zanesville.
   (f)   Section 302.4 Weeds insert 8" as the maximum weed or plant growth height.
   (g)   Under Section 304.2 Weeds add Section 302.4.1 which shall read as follows: Property owners and/or tenants shall mow or cut as described in section 302.4 to the edge of abutting streets or alleys including to the center line of adjoining center street/tree lawns (Islands) and along all fences, walls or buildings.
   (h)   Under Section 302 Exterior Property Areas add Section 302.10 Property owners shall remove all dead and dangerous trees or tree limbs which are determined by the code official to be a threat to public safety or property and properly dispose of all debris.
   (i)   Section 303.2 Shall be amended to read as follows: Private swimming pools, hot tubs and spas shall be installed and secured by enclosures per Section 1159.07 of the Codified Ordinances of the City of Zanesville.
   (j)   Section 304.1.1 Unsafe Structures shall be amended to read as follows: The following conditions shall be determined as unsafe and shall be repaired or replaced to comply with the currently adopted Ohio Building Code or the Residential Code of Ohio as required for existing buildings:
   (k)   Section 304.14 Insect screens insert dates of April 1 to December 1.
   (l)   Section 305.1.1 Unsafe conditions shall be amended to read as follows: The following conditions shall be determined as unsafe and shall be repaired or replaced to comply with the currently adopted Ohio Building Code or the Residential Code of Ohio as required for existing buildings:
   (m)   Section 306.1.1 Unsafe conditions shall be amended to read as follows: Where any of the following conditions cause the component or system to be beyond its limit state, the component or system shall be determined as unsafe and shall be repaired or replaced to comply with the currently adopted Ohio Building Code or the Residential Code of Ohio as required for existing buildings:
   (n)   Section 307.1 General shall be amended to read as follows: Every exterior and interior flight of stairs having four or more risers shall have a handrail on one side of the stair and every open portion of a stair, landing, balcony, porch, deck, ramp or other walking surface which is more than 30 inches (762 mm) above the floor or grade below shall have guards. Handrails shall not be less than 34 inches high or more than 38 inches high measured vertically above the nosing of the tread or above the finished floor of the landing or walking surfaces. Guards shall not be less then 36 inches high for residential applications or 42 inches for commercial applications above the floor or the landing, balcony, porch, deck, or ramp or other walking surface.
Exception: Guards shall not be required where exempted by the    adopted building code.
   (o)   Section 401.3 Alternative devices shall be amended by the following change: Delete International Building Code and insert Ohio Building Code or the Residential Code of Ohio.
   (p)   Section 403.1.1 Habitable Spaces shall be added to read as follows: The interior side of a window shall not be covered with any material other than that which is specifically designed for window cover such as blinds, curtains, drapes, or shutters.
   (q)   Section 602.3 Heat supply shall be amended to read as follows: Every owner and operator of any building who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guestroom on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from October 1 to May 15 to maintain a temperature of not less than 68 F (20 C) in all habitable rooms, bathrooms, and toilet rooms.
   (r)   Section 602.4 Occupied workspaces shall be amended to read as follows: Indoor occupied workspaces shall be supplied with heat during the period from October 1 to May 15 to maintain a temperature of not less than 65 F (18 C) during the period the spaces are occupied.
   (s)   Section 604.2 Service shall be amended to read as follows: The size and usage of appliances shall serve as a basis for determining the need for additional facilities in accordance with NFPA 70 (National Electric Code). The dwelling unit shall be served with a three-wire, 120/240-volt, single phase electrical service having a minimum rating of 100 amperes.
