129.01 AUXILIARY POLICE FORCE.
   (a)   Creation and Appointment. There is hereby created within the Department of Public Safety an auxiliary police force, with members to be appointed by the Director of Public Safety.
   (b)   Term. Auxiliary police officers shall serve so long as the Director of Public Safety may direct, or until a resignation submitted by such member shall be accepted by the Director of Public Safety.

   (c)   Qualifications. The members so appointed shall reside within the boundaries of Muskingum County or fourteen air miles, as measured from the Courthouse, which is located at the corner of Fourth and Main Streets, and may not be under the age of twenty-one years at the time of their appointment.

   (d)   Control and Command. The Police Chief shall be the commanding officer of the auxiliary police force and, subject to the approval of the Director of Public Safety, shall have control of the assignment, training, stationing and the direction of work of such force. The auxiliary police force will have all police powers but shall perform only such police duties as are assigned by the Police Chief and shall act only when in the prescribed uniform or portion of uniform. The Police Chief shall prescribe the time and place such uniform or portion thereof shall be worn. Auxiliary members shall obey the chain of command of the Police Department and shall take orders from all regular and appointed members thereof.
   (e)   Uniform. The Director of Public Safety is hereby authorized to prescribe the type of uniform or part thereof which shall be worn.
   (f)   Voluntary Services Without Pay. The Police Chief shall, with the approval of the Director of Public Safety, prescribe the rules and regulations for the conduct and control of the auxiliary police force. All services performed by auxiliary policemen shall be on a voluntary basis and within the City. Auxiliary policemen shall serve without pay.
   (g)   Nonliability. This section is declared by Council as an exercise by the City of its police powers for the protection of the public peace, health, property, safety and general welfare, and neither the City or any agent or representative of the City, or any individual, firm, partnership, corporation or the receiver or trustee or any other agent thereof, who in good faith, execute any executive order, rule or regulation promulgated pursuant to the provisions of this section shall be liable for injury or damage sustained to any person or property as the direct or proximate result of such action.
   (h)   Rules and Regulations. The Director of Public Safety is hereby authorized and directed to promulgate such executive orders, rules and regulations as, in his discretion, are either necessary or desirable in the administration of such auxiliary police force.
   (i)   Conflict. The provisions of this section, individually or severally, shall not be construed as intended by Council to be in conflict with any Federal or State statute, or with any military or naval order, rule or regulation.
