(a) Failure of an industrial user, hauler, business, person, or entity to comply with any provision of this chapter shall be subject to a penalty of three thousand dollars ($3,000) per day per violation. Each such failure to comply shall be deemed a distinct and separate offense and the appropriate fine shall be levied accordingly. Fines shall be collected by the City in the same manner as all other charges set by the City.
(b) Any industrial user, hauler, business, person, or entity who has violated or continues to violate this chapter or order issued hereunder, shall be liable for actual damages incurred by the POTW per violation for as long as the violation continues. In addition to the above described penalty and damages, the Director may recover reasonable attorney's fees, court costs and any other expenses associated with the enforcement activities, including sampling and monitoring expenses.
(c) No unauthorized person shall maliciously, willfully or negligently break, damage, destroy, remove, deface or tamper with any structure, appurtenance or equipment which is part of the sewage works. Whoever violates this provision shall be guilty of a first degree misdemeanor. (Ord. 17-13. Passed 2-27-17.)
