(a) Information and data furnished to the Director with respect to the nature and frequency of discharge shall be available to the public or other governmental agency without restriction unless the discharger specifically requests confidentiality, at the time such information and data is furnished on the basis that the release of such information would divulge information, processes or methods of production entitled to protection as trade secrets or proprietary information of the discharger. The discharger shall stamp the words "CONFIDENTIAL" on each page containing confidential information.
(b) Except as provided in subsection (d) hereof, any information accepted by the Director as confidential shall not be transmitted to the general public without prior and adequate notification and permission of the discharger.
(c) Except as provided in subsection (d) hereof, any data and information submitted to the City as confidential shall be made available to governmental agencies for uses related to these regulations, the City's NPDES Permit, Ohio and/or Federal Pretreatment Programs and judicial review or enforcement proceedings involving the discharger, provided that:
(1) A written request for such data and information is received from the governmental agency stating the reasons for the request and uses for the data and information;
(2) A ten-day notification of the Director's intent to provide such information is given to the discharger. The notification shall include a copy of the governmental agency's written request and a specific description of the confidential information to be provided.
(d) Wastewater constituents and characteristics will not be recognized as confidential information.
