901.03 PERMIT ISSUANCE; CONDITIONS AND DEPOSIT.
   The Director of Public Safety shall not issue any permit to cut or excavate any street, thoroughfare, park or other public ground unless for some lawful purpose, and unless such cut or excavation is reasonably necessary. He may in granting any permit modify any particulars of the application therefor, and impose conditions therein, for the purpose of minimizing any inconvenience or injury to the public and the public property thereby. He shall not issue such permit until the applicant shall have deposited with the City a sum of money sufficient to defray the cost of refilling such excavation, removing any excess materials and restoring the pavement or other surface, as may be required by ordinance and to the satisfaction of the Director of Public Service. A permit duplicate thereof shall be made out at the time the permit is issued, which copy shall go the the Director of Public Service.
   The deposit to be made under this section shall be at the rate of five dollars ($5.00) per square foot.
