Unless otherwise provided:
(A) A first violation of this chapter is a civil offense and shall be punished by a fine of not less than $50 per violation.
(B) A second violation of this Chapter within one year of a finding of responsibility of a first violation is a civil offense and shall be punished by a fine of not less than $250 per violation.
(C) A third or subsequent violation of this chapter within one year of a finding of responsibility of a first violation is a class one misdemeanor and shall be punished, in addition to any other penalties authorized by law, by a fine of not less than $1,000 per violation.
(D) Notwithstanding subsection (C) above, the city may designate third or subsequent violations of this chapter as civil offenses and such violations shall be punished by a fine of not less than $500 per violation.
