All money or stakes being used in the conduct of any gambling game, when seized by police officers shall be brought before the city magistrate and if the magistrate upon hearing the evidence, should find the same to have been used in conducting a gambling game, such money or stakes shall be forfeited to the city by the magistrate ordering such money or stakes deposited with the Finance Director.
