6.04.075   Dogs prohibited—Exceptions.
A.   The city council finds that it is in the public interest to promote the health, safety, and general welfare of its residents and visitors that choose to attend Market Night and certain city sponsored or approved special events by restricting the presence of dogs at such events.
B.   At Market Nights, dogs shall be prohibited from being within twenty (20) feet of any area where food is stored or held safe, including, but not limited to, temporary food vendor booths, and shall not be allowed in the Certified Farmer’s Market portion of the Market Night area.
C.   Unless prohibited or further restricted through conditions imposed on a special event permit or other event approval, dogs shall be permitted at city sponsored or approved events, subject to the following limitations:
1.   Dogs shall be prohibited from being within twenty (20) feet of any area where food is stored or held safe, including, but not limited to, temporary food vendor booths.
2.   Dog owners and event operators shall comply with applicable county health department regulations and state laws applicable to the event.
3.   At any public event at a city facility, such as concerts in the park, staff may designate and post areas within the facility in which the event is held where dogs are prohibited.
D.   Exceptions. Dogs meeting the following criteria shall be exempt from the prohibitions and restrictions in subsections B and C above:
1.   Assistance dogs which have been specially trained and that are being used in a law enforcement or rescue capacity;
2.   Guide dogs, signal dogs, and service dogs, as defined in Food and Agricultural Code Section 30850 et seq., which are being or have been specially trained to be used by disabled persons to aid and assist them;
3.   Dogs used in connection with the activities authorized in the issuance of a special event permit pursuant to Sections 5.16.020 and 5.16.090 of this code. (Ord. 325 § 2, 2013; Ord. 213 § 2, 2001)
