§ 152.123 PRELIMINARY PLAT WAIVED WHEN.
   The requirement for a preliminary plat may be waived if the Plan Commission determines that a proposed subdivision would create only two or three lots and would not include the creation of any part of any street, public easement or other right-of-way, whether public or private, for access to or from such lots. In such cases the Commission may permit an application for approval of the subdivision to be accompanied by the final plat. The purpose of this variance is limited to a simplification of procedural requirements in this special class of cases where submission of a preliminary plat is considered to be unnecessary. In addition to complying with all requirements of §§ 152.045 through 152.048, the final plat in such cases shall also be accompanied by the materials specified in § 152.026. No other procedural or substantive requirement of this chapter may be waived for this purpose, including tentative approval, public hearing and final approval.
