§ 51.99 PENALTY.
   The following penalties are established:
   (A)   If any service rate or charge established shall not be paid within 30 days after the same is due, the Town Council may cause a civil action to be instituted in the name of the Town of Yorktown, Indiana to recover the amount thereof, together with a penalty of 10% and reasonable attorney’s fees, as provided by law, or may enforce collection by any other remedy provided by law;
   (B)   For unauthorized dumping into the town sewage collection system a fine of up to $500 shall be imposed for illegal dumping into the town sewage system. The amount of the fine shall be dependent upon the volume and composition of material. The amount of the fine shall be set by the Town Manager and WWTP Superintendent.
   (C)   Any person, firm, or corporation violating any provisions of § 51.09 shall be subject to a written warning by the WWTP Superintendent for a first offense, not less than $200 for a second offense, and not less than $400 for any subsequent offense. Any person who acts as a certified I/I Inspector and violates any of the provisions of § 51.09 shall be subject to a fine of $1,000 for providing false and misleading information on the "Certification Form for I/I" or the "Request for Waiver" form. If said false or misleading information allows any property to be declared I/I compliant, then the I/I Inspector shall be subject to an additional $100 fine per month until the town accepts a valid I/I certification. A firm or corporation that employs a person that violates § 51.09 is also subject to the fines outlined in this section.
   (D)   Any person who shall continue any violation beyond the time limit provided for in § 51.34(A) shall be guilty of a misdemeanor and on conviction thereof shall be fined in an amount not exceeding $1,000 per day, per violation, in accordance with 40 CFR 403.8 (f)(1)(vi)(A), but no more than $2,500 per day, per violation for a first violation nor more than $7,500 per day, per violation for subsequent violations, in accordance with I.C. 36-1-3-8(a)(10)(B).
   (E)   Any person violating any of the provisions of §§ 51.20 through 51.36 shall become liable to the town for any expense, loss, or damage occasioned the town by reason of such violation.
