§ 51.09 REDUCTION OF INFLOW AND INFILTRATION.
   (A)   Adoption of the reduction of inflow and infiltration. The town hereby adopts the Reduction of Inflow and Infiltration Ordinance. This ordinance addresses the problem of clear water from downspouts, sump pumps, foot drains, and other clear water drains, entering the sanitary and storm sewer systems of the town. This program shall address public and private locations.
   (B)   Appointment of department to administer ordinance. The Wastewater Treatment Department shall have the authority to conduct inflow and infiltration inspections on an as-needed basis, not to exceed more than once per year per residence or business.
   (C)   New construction. Any new construction shall require an I/I certification prior to connection of utilities.
   (D)   Remodeling. Any remodeling which requires a building permit shall also require an I/I certification, before a certificate of occupancy can be issued.
   (E)   Re-sale. Any sale of property shall require an I/I certification before utilities can be reconnected by a new owner.
   (F)   Commercial. All existing commercial buildings shall have six months from the adoption of this section, to acquire an I/I certification. Any person, firm, or corporation who owns commercial property and does not provide acceptable I/I certification by July, 2006, shall be subject to a fine of $100 for each month after August, 2006.
   (G)   Certification.
      (1)   Certification shall be issued by the Yorktown WWTP, upon completion of certification training.
      (2)   No fee shall be required for certification.
      (3)   Certification need not be renewed annually.
