The provisions herein are adopted pursuant to the authority conferred upon York County (the “county”) by the South Carolina Constitution, the South Carolina General Assembly including S.C. Code §§ 48-1-10 et seq. (the “South Carolina Pollution Control Act”), and §§ 48-14-10 et seq. (the “South Carolina Stormwater Management and Sediment Reduction Act”), and the regulations promulgated thereunder; and, in compliance with the requirements imposed upon the county by the National Pollutant Discharge Elimination System (NPDES) General Permit for Storm Water Discharges from Regulated Small Municipal Separate Storm Sewer Systems (SMS4s), issued in accordance with the federal Clean Water Act, the South Carolina Pollution Control Act and regulations promulgated thereunder.
