11-2-5: DEVELOPMENT AGREEMENTS; PROCEDURES AND REQUIREMENTS:
Any developer desiring to enter into a development agreement with the city must complete the following process:
   A.   Submit an original signed development agreement application and the original signed written development agreement to the city planning department.
      1.   The development agreement application and the development agreement must be submitted at least sixty (60) days prior to the tentative subdivision or parcel map expiration date.
      2.   This agreement must describe the land which is the subject of the agreement and specify the duration of the agreement, the permitted uses of the land, the density or intensity of its use, the maximum height and size of the proposed buildings and any provisions for the dedication of any portion of the land for public use. The agreement may fix the period within which construction must commence and provide for an extension of that deadline.
      3.   Pay all fees for the development agreement as found in the most current revision of the city of Yerington fee schedule.
      4.   The application does not bind either party. Its sole purpose is to provide the city council with information prior to the public hearings.
      5.   Six (6) copies must be submitted to city council.
      6.   One copy must be submitted to the city attorney.
      7.   The sole responsibility of drafting the development agreement application and the development agreement rests upon the property owner/developer. The city attorney shall neither create nor provide legal assistance in the creation of the first draft of any development agreement application and development agreement.
   B.   After the second public hearing, the city council may vote and finalize the development agreement or the property owner/developer may request the development agreement be placed on a future agenda of the city council after any changes required by the city council are made to the initial agreement.
   C.   Within five (5) business days after approval of the agreement, the city clerk shall cause the original agreement to be recorded with the county recorder. Upon recordation, the agreement binds all parties and their successors in interest for the duration of the agreement. (Ord. 08-02, 9-22-2008)
