9-4-11: VARIANCES:
   A.   Existing Parks: This section does not apply to existing mobile home parks, except when an existing mobile home park is remodeled, expanded, or reconstructed.
   B.   Power To Grant: The city may grant a variance to waive any of the requirements of this chapter with respect to a particular development at the time of approval.
   C.   Criteria For Approval: Such variances shall not be granted unless the developer has submitted an application with the city and the city finds that each of the following conditions exist:
      1.   There are special conditions or circumstances particular to the proper justification of the variance;
      2.   Strict application of the requirements of this chapter would cause extraordinary and unnecessary hardship in developing the property;
      3.   Such waiver would not in effect nullify the objectives of the chapter or any other law or ordinance applicable to the development;
      4.   Such waiver would not be injurious to adjacent properties or detrimental to the health, safety, convenience and welfare of the public.
   D.   Conditions: The variance may contain conditions. Failure to conform to such conditions will be grounds for disapproval. (1973 Code § 15.28.010)
