5-2-2: DISTURBING THE PEACE:
   A.   Unlawful Assembly: No two (2) or more persons shall assemble for the purpose of disturbing the public peace or committing any unlawful act within the city and fail to disperse when being commanded to do so by a judge, justice of the peace, chief of police, constable or other public officer. (1973 Code § 9.52.010)
   B.   Disorderly Conduct: No person shall make in any place, or suffer to be made upon his premises or premises within his control, any noise, disorder or tumult, disturbance of the public peace.
   C.   Obscenity: No person shall utter within the hearing of any person, any obscene language, words or epithets, nor address to another, or utter in the presence of another, any words, language or expression having a tendency to create a breach of peace. (1973 Code § 9.52.020)
   D.   Indecent Or Obscene Exposure: (Rep. by Ord. 02-04, 7-22-2002)
   E.   Disturbing The Peace: No person shall maliciously and wilfully disturb the peace and quiet of any neighborhood or family within the city by loud or unusual noises or by tumultuous and offensive conduct, threatening, traducing, quarreling, or challenging to fight or fighting. (1973 Code § 9.52.030)
   F.   Public Disturbance Noise From Portable Or Motor Vehicle Audio Equipment:
      1.   While in park areas, residential or commercial zones within the city, or in any area where residences, schools, parks, human service facilities or commercial establishments are in obvious proximity to the source of the sound, it is unlawful for any person to negligently cause, make or allow to be made from audio equipment under such person's control or ownership, the following:
         a.   Sound from a motor vehicle audio system, such as a radio, tape player or compact disc player, which is operated at such a volume that it could be clearly heard by a person of normal hearing at a distance of seventy five feet (75') or more from the vehicle itself; or
         b.   Sound from portable audio equipment, such as a radio, tape player or compact disc player, which is operated at such a volume that it could be clearly heard by a person of normal hearing at a distance of seventy five feet (75') or more from the source of the sound.
      2.   This subsection shall not apply to persons operating portable audio equipment upon their own premises, such as an owner or tenant, or to persons operating such equipment pursuant to any permit issued under the authority of this code.
      3.   This subsection is not applicable in any district zoned M-1 or outside the city as defined by this code and which is not located in any area where residences, schools, parks, human service facilities or commercial establishments are in obvious proximity to the source of the sound.
      4.   The content of the sound will not be considered in determining a violation of this section. (1973 Code § 9.52.040)
   G.   Penalty: Any person violating any provision of subsection F of this section is guilty of a misdemeanor and, upon conviction thereof, is punishable by a fine as listed on the city of Yerington fee schedule. (Ord. 03-07, 11-24-2003)
