4-5-3: PERMIT REQUIRED:
   A.   Required: Commencing on the effective date hereof, it is unlawful for any person to install an aboveground fuel tank within the city without a permit therefor approved by the city council.
   B.   Written Application: To obtain a permit to install an aboveground fuel tank within the city, a person shall make written application therefor at the Yerington city hall. The application shall contain such information as the chief of the fire department and the state fire marshal deem necessary to assist the chief of the fire department in determining whether the permit should be approved. (1973 Code § 8.17.030)
   C.   Fee: Each application shall be accompanied by a nonrefundable fee per the city of Yerington fee schedule payable to the city. Fees may be waived for governmental entities at the sole discretion of the city council. (Ord. 03-06, 10-13-2003)
   D.   Recommendation To Council: Upon receipt of the completed application, and after its review by the state fire marshal, the chief of the fire department shall recommend to the city council whether to approve or deny the permit. A recommendation of approval may only be made upon a finding by the chief of the fire department that the installation of said aboveground fuel tank will be installed and designed in accordance with the most current edition of the international fire code as adopted by the city of Yerington, and will in no way jeopardize the health and safety of residents of the city.    E.   Notice To Adjacent Property Owners: The chief of the fire department shall notify, in writing, each property owner whose property is within two hundred feet (200') of the property on which the application to install an aboveground fuel tank has been received so that the property owner may submit written comments concerning the application and attend the hearing at which the application is considered.
   F.   Hearing: At the hearing, the city council shall consider the application and any written or oral comments received from any other interested person. The council shall limit its consideration of the above to protection of health and safety of city residents.
   G.   Final Action By Council: The city council shall take final action on the recommendation of the chief of the fire department as soon as practicable after receipt thereof. Any condition imposed on the approval of the permit shall be strictly adhered to by the applicant and failure to do so constitutes cause for its immediate revocation.
   H.   Issuance; Records; Inspections: The chief of the fire department shall issue the permit when directed to do so by the city council. The chief of the fire department shall maintain a record of the date of issuance of, the conditions imposed on, and the person to whom a permit has been issued pursuant to this section. The chief of the fire department, from time to time, but not less than twice yearly, shall inspect the premises which is the subject of the permit to determine whether the permittee is in compliance with the permit conditions.
   I.   Right To Limit: The city council has the right to limit the number of aboveground fuel tanks to be permitted within the city. (1973 Code § 8.17.030)
