1043.04 EXTRATERRITORIAL CUSTOMERS.
   (a)   Applicability. Subject to the terms and conditions of this section, the Village may provide broadband services to customers located outside the boundaries of the Village on a case-by-case basis, based on proximity and availability of utility services.
   (b)   Rates and Fees. Extraterritorial customers outside the Village limits shall pay the applicable residential or non-residential rates for services and applicable fees for installation, etc. Extraterritorial customers shall pay a ten percent rate-only surcharge monthly. Extraterritorial customers are not entitled to request the Utility Dispute Resolution Board process or to apply for any promotional rates.
   (c)   Terms and Conditions. Extraterritorial customers may be subject to additional terms and conditions based on the availability of service, including infrastructure extension.
   (d)   Capital Costs and Installation Charges. Unless otherwise authorized by Council, extraterritorial customers shall pay capital reimbursement on design and construction of any additional equipment necessary for expansion of utility service to the extraterritorial customer, including but not limited to the fiber, electronic equipment, and any necessary data center improvements. Extraterritorial customers shall pay for the drop or lateral from the fiber-optic main line to the optical line terminal, and the installation of the indoor equipment to connect the optical line terminal to the optical network terminal.
