§ 1025.09 PROHIBITIONS.
   (a)   Prohibitions. No person shall violate any of the following prohibitions:
      (1)   No solid waste container or cart shall be left at the curb or place of collection before noon on the day prior to the user's scheduled weekly collection or past noon on the day after the user's weekly collection has occurred.
      (2)   No construction waste, hazardous waste, dead animals, commercial waste, industrial waste, and/or rubbish shall be placed in any residential waste container or cart.
      (3)   Bulky waste shall not be placed for collection or in any public right-of-way before 12:00 p.m. of the day prior to the customer's scheduled collection.
      (4)   Containers and bulky waste placed for collection shall not placed in such a way as to obstruct or damage the right-of-way, block or obstruct a sidewalk, in the street, or in any manner that creates a safety hazard.
      (5)   No person shall upset or scatter any solid waste container, and no person shall deface, mutilate, destroy, or damage a City-provided solid waste container or the solid waste container of another.
   (b)   Unlawful Deposits; Burying or Burning.
      (1)   No person shall deposit, or cause to be deposited, any solid waste, rubbish, refuse or garbage in any alley or other public place, or upon any private property, whether owned by such person or not, within the City, unless it is in a proper container for collection. Any unauthorized accumulation of solid waste, rubbish, refuse or garbage on any premises is hereby declared to be a nuisance. This division (b)(1) does not prohibit composting, if such composting is done in a contained manner that prevents the blowing or scattering of waste around the property of the property owner, onto the property of others, or onto any public property or public street, and is done in such a manner as to prevent noxious odors.
      (2)   No person shall throw or deposit any solid waste, rubbish, refuse or garbage in any stream or other body of water.
      (3)   The burying of solid waste, refuse, or garbage within the City is expressly prohibited; provided, however, that this division (b)(3) does not prohibit the burying of compost or of rocks, sod, dirt, earth, sand, tree branches, roots, stumps or similar types of yard waste.
      (4)   The burning of solid waste, rubbish, refuse, garbage, or any putrescible substance within the City is expressly prohibited.
