§ 1049.05 EROSION, SILTATION AND SEDIMENTATION.
   (a)   The city shall be responsible for controlling erosion, siltation and sedimentation that will adversely affect storm sewers, drainage ditches, watercourses and other drainage facilities. It shall not be concerned with slips and slides of earth; however, it shall be concerned with the pollution of public waters and watercourses carrying sediment from accelerated soil erosion and accelerated storm runoff caused by earth-disturbing activities insofar as they clog, change or alter the carrying capacity of drainage facilities. It shall be concerned with other activities causing erosion, siltation or sedimentation, other than construction procedures, that might hinder proper drainage. Reference Chapter 1226 of the Codified Ordinances of the City of Xenia, Ohio.
   (b)   The city shall not be responsible for erosion, siltation and sedimentation for projects of other governmental agencies. The other government agencies must follow city regulation governing stormwater runoff at their expense.
