§ 1049.04 STORM SEWERS.
   (a)   The city shall monitor the design, operation, maintenance, inspection, construction and use of all storm sewers, storm drains, and stormwater facilities in the city. The city shall be responsible for the design and construction of public stormwater facilities in the city and shall inspect, operate and maintain them.
   (b)   The city may authorize the construction of ancillary curbs, pavements, channels, watercourses, conduits, culverts or other structures necessary to properly operate and maintain stormwater facilities.
   (c)   The city shall provide for inspection and routine maintenance of city owned stormwater facilities within the XSSD. Maintenance may include city owned catch basin cleaning, grating and casting repair, inlet and outlet structure repair, channel clearing, erosion repair, and other incidentals. The city shall provide for remedial maintenance of facilities based upon the severity of stormwater problems and potential hazard to the public. Remedial maintenance of bridge surface drainage systems shall remain the responsibility of agencies other than the city.
   (d)   Any fees associated with remedial maintenance of privately owned stormwater facilities shall be assessed to the owner or homeowners’ association.
   (e)   For the purposes of this chapter, storm sewers begin at the grating or opening where water enters the structure, through the sewer and conduits to the outlet structure where water enters a channel, natural watercourse or storm sewer.
