(a) (1) No person shall place any advertisement, newspaper or sample merchandise in or upon private property within the City without the request of the property owner or lessee thereof, without having obtained a permit from the City Manager to do so, which permit shall state the items to be so distributed. The Manager shall grant such permit to responsible persons or organizations upon the payment of an annual fee determined in accordance with the most current schedule of fees adopted by the City Council and shall be adjusted periodically to reflect any increases or decreases of such fees.
(2) The person requesting such permit shall provide to the City the address and telephone number where the permit holder may be contacted by property owners or lessees. The permit shall be valid for one year from the date of issuance and may be renewed annually. Upon the written or oral request of a property owner or lessee to cease the placement of such items upon the property owner’s or lessee’s property, such permit holder shall forthwith comply with such request. It shall be a condition of such permit that any items distributed shall contain the name, address and telephone number of the responsible person to whom requests for discontinuance of distribution may be given and distribution of such items without such information shall constitute a violation of this section.

(b) The City Manager shall maintain a list, by street address, of property owners and lessees who notify him of their desire that no such items be placed on their premises. Concurrently with the grant of a permit under subsection (a) hereof, and annually thereafter, an updated copy of such list shall be forwarded to all current permit holders. It shall be a condition of the permit that the holder thereof shall not place such items on the premises listed.
(c) It shall be a further condition of the permit that the holder thereof shall collect and remove distributed items which have been discarded in bulk, promptly upon notification thereof.
(d) Upon receipt of repeated reports of noncompliance with requests to cease distribution under subsection (a) hereof, or of distribution to those listed in subsection (b) hereof, or of failure to collect and remove under subsection (c) hereof, the City Manager may, after suitable hearing, revoke the permit of such violator.

(e) Section 733.11 shall not apply to the distribution of literature by religious, charitable or political groups, organizations or individuals.

(f) All existing permits shall be renewed at the fee rate herein on the anniversary date of their original issue. In the event that the date of original issue cannot be determined, then a renewal of an existing permit shall be obtained within one year from the effective date of this subsection.
