The terms and conditions of a Planned Unit Development, and the covenant that runs with the land shall be enforceable by owners of real estate covered by the development or by the City. Failure to enforce shall not be deemed a waiver of the right of enforcement. Original and all subsequent owners within a Planned Unit Development take subject to a covenant running with the land whereby they waive the defense of laches against any person or body that has power to enforce the Planned Unit Development.
