1181.03 INTENSITY OF USE AND NONCONFORMITY.
   The basic area requirements for dwelling units in any district wherein a Planned Unit Development is located may be abated to the maximum extent of ten percent (10%). Such area requirements cannot otherwise be abated; however, they shall not be imposed upon individual dwelling units, but upon the development as a whole, so that the result of dividing the total gross area of the development by the approved area per dwelling unit shall yield the permitted whole number of units for the development, fractional amounts being disregarded.
   All requirements of the Zoning Code other than the foregoing area requirements may be waived or modified to any extent consistent with this chapter, by approval of a Development Plan containing items inconsistent with such requirements.
   The application of this section to area requirements may be exemplified as follows:
   (a)   If a ten-acre tract is developed in the AAAA Single-Family Residence District, which requires lot area of not less than 40,000 square feet per dwelling unit, the area requirement may be abated to require 36,000 square feet per dwelling unit, and if abated, twelve dwelling units may be placed in the development (10 acres = 435,600 square feet. 435,600 square feet divided by 36,000 square feet = 12.1).
   (b)   If a 220,000 square foot tract is developed in the C-1 District, which requires lot area of not less than 5,000 square feet per dwelling unit, the area requirements may be abated to require 4,500 square feet per dwelling unit, and if abated, forty-eight units may be placed in the development (220,000 square feet divided by 4,500 square feet = 48.89).
In the event that the tract to be developed is located in more than one zoning district, the ten percent (10%) area abatement shall be calculated by dividing the total gross area of each zoning district contained in the development by the approved area per dwelling unit to obtain the whole number of units for that portion of the development, and adding all such numbers together, for example:
   (c)   A ten-acre tract, comprised of five acres in the AAAA Single-Family Residence District, which requires lot area of not less than 40,000 square feet per dwelling unit, and five acres in the AAA Single-Family Residence District, which requires lot area of not less than 20,000 square feet is proposed for a Planned Unit Development. The area requirement may be abated to require 36,000 square feet per dwelling unit in the AAAA District, and 18,000 square feet per dwelling unit in the AAA District. If abated, eighteen dwelling units may be placed in the entire development (AAAA: 5 acres = 217,800 square feet. 217,800 square feet divided by 36,000 square feet = 6.05. AAA: 5 acres = 217,800 square feet. 217,800 square feet divided by 18,000 square feet = 12.1. 12.1 + 6.05 = 18.15).
