§ 97.001 CLOSING HOURS.
   (A)   (1)   All city-owned parks, playgrounds and parking lots shall be closed from 10:00 p.m. to 6:00 a.m. each day unless said areas have signs posted setting forth a different closing time. In addition, the public parking lots servicing the Yack Arena and within the area bounded by Biddle Avenue, Eureka Avenue, Third Street and Elm Street shall be closed from one-half hour after the public function at the Yack Arena ends until 6:00 a.m.
      (2)   The City Council may from time to time, by resolution, revise the hours of closing. In addition, the Chief of Police or his or her designate from the Police Department may order any city-owned park, playground, parking lot or publicly-owned area immediately closed if he or she determines any of the following exists:
         (a)   There exists a public crisis, emergency, rioting or civil disturbance within any city-owned park, playground, parking lot or other publicly-owned area, or within such proximity thereto as to create a danger to persons or property within the city;
         (b)   Injuries to persons or damage to property have occurred or there is a probability that the same will occur and that the public safety is imperiled, and there is apprehension of further danger to persons or property; and/or
         (c)   Persons have gathered and remained in a city-owned park, parking lot, playground or publicly-owned area in such numbers that the Chief of Police or his or her designate from the Police Department determine that said assemblage of persons at one time causes any of the following conditions to exist:
            1.   Obstruction of the free passage of pedestrians or vehicles within the parking lot, nearby streets or publicly-owned area;
            2.   Any disturbance or annoyance to the comfort and repose of others, including surrounding residents and passers-by; and/or
            3.   The Police Department with the available manpower on duty at that time is unable to effectively supervise the area in question and unable to protect the public safety, health or welfare or unable to protect the city property and surrounding privately-owned property.
   (B)   It shall be unlawful for any person, excepting law enforcement officers or other persons on official city business, to be within the confines of any city-owned parks, playgrounds, parking lots or publicly-owned area in violation of the terms of this section.
