§ 51.002 RECEPTACLES; GENERALLY; PROTECTION.
   (A)   General.
      (1)   The person in charge of any dwelling, building or structure shall provide a receptacle of substantial construction for the receipt of solid waste and deposit therein or cause to be deposited all solid waste resulting from the use of the premises and place the same in locations designated by the city. Solid waste shall not be stored in the front yards. The storage of solid waste shall only be stored in a rear yard in a receptacle with a cover.
      (2)   Each receptacle for solid waste shall be constructed of metal or durable plastic, or an approved equal material, and shall have a tight-fitting cover sufficient to make it water-tight, fly-proof, odor-proof and prevent entry by rodents or other animals. Such containers shall not exceed 32 gallons in capacity and shall not weigh more than 60 pounds when filled. In addition to the above, the city will make available for lease 96-gallon totes with 250-pound capacities. Receptacles shall not include plastic bags.
      (3)   All special refuse items (e.g., refrigerators and tires) shall be labeled with an appropriate special refuse sticker to be obtained from the city. Failure to so label shall result in collection costs as defined in § 51.008 of this chapter. The continued failure to pay such costs may result in placement of a lien upon the affected property and/or the initiation of the appropriate ordinance violation action against the owner thereof.
      (4)   Notwithstanding divisions (C) and (D) below, upon written notice from the city, multiple residential, commercial and industrial premises must place all solid waste in non-portable rear load or front load receptacles. All apartment buildings with six or more residential units are required to have non-portable rear load or front load receptacles.
      (5)   For purposes of this section, a rebuttable presumption as to the ownership of any solid waste shall exist if at least two pieces of documentation indicating or substantiating such ownership are recovered from among said material.
      (6)   The owner or occupant shall utilize sufficient number of containers with covers to conveniently store the accumulation of solid waste.
      (7)   It shall be unlawful for any person to steal or counterfeit a special refuse sticker. In addition to § 51.999 of this chapter, the city may pursue criminal penalties for a violation of this division (A).

   (B)   Protection from scattering, animals and the like. The occupant of any dwelling, building or structure shall arrange, locate, cover or protect all receptacles or special containers required herein so that the contents thereof cannot be removed therefrom by animals or blown out by the wind and scattered over any public or private property within the city.

   (C)   Rubbish generally. Rubbish may also be placed in non-portable rear load receptacles approved by the City Engineer which can be mechanically handled by collection equipment of the city contractors. Should a non-portable rear load receptacle be utilized, the charges will be determined by resolution of the City Council.

   (D)   Commercial rubbish.
      (1)   Commercial rubbish may be placed in non-portable rear load or front load receptacles of substantial metal construction of two to four cubic yards capacity and shall meet all specifications established by the City Engineer on the basis of the requirements of the solid waste equipment being used by the city contractor.
      (2)   Corrugated cardboard may be placed in non-portable corrugated cardboard receptacles of substantial metal construction of six-cubic-yard capacity as supplied by the city contractors.
      (3)   Receptacles that are badly broken or otherwise fail to meet the requirements of this division (D) may be classified as rubbish and, after due notice to the owner, may be collected as rubbish by the Department.
      (4)   Receptacles that are badly broken or otherwise fail to meet the requirements of this section may be classified as rubbish and, after due notice to the owner, may be collected as rubbish by the Department.
      (5)   Should a non-portable rear load receptacle or non-portable corrugated cardboard receptacle be utilized, the charges will be determined by resolution of the City Council.

   (E)   City-owned receptacles. City-owned rubbish receptacles are placed in business streets for the convenience of pedestrians, shoppers and the general public; no commercial rubbish, domestic rubbish or garbage, except sweepings from in front of establishments, shall be deposited herein by the owner or employee of any business or commercial establishment.
