§ 32.017 VOLUNTARY WITHDRAWAL OF ANNUITY OPTION.
   (A)   Under this option, a general member, police member or a fire member retiree of the surviving spouse of said retiree may, only at the time of the selection of a retirement allowance option, choose to have 25%, 50%, 75% or 100% of the accumulated contributions returned in a lump sum. The retirement allowance shall be reduced by the actuarial equivalent of the accumulated contributions withdrawn, effective 10-4-1976.
   (B)   Effective 10-1-1977, the above provisions also apply to a municipal service member retiree; except that, the surviving spouse of a municipal service member retiree shall not be entitled to select any return of any accumulated contributions in a lump sum.
   (C)   Upon the written request of a general, police officer or firefighter member who is an active member on 10-1-1982, his or her accumulated contributions as of 11-15-1982 for non-union general members, 2-21-1983 for union general members, 3-21-1983 for command officer police officer members, 3-18-1984 for patrol officer police officer members and 3-21-1983 for firefighter members shall be returned to him or her in a lump sum.
   (D)   Upon the written request of an exempt or non-exempt salaried municipal service member, as determined by the Municipal Service Commission, who is an active member on 7-1-1983, his or her accumulated contributions as of 6-1-1983 shall be returned to him or her in a lump sum. Any hourly municipal service member who shall become an exempt or non-exempt salaried municipal service member after 6-1-1983 shall be governed by and be entitled to the benefits of this division (D).
   (E)   Upon the written request of an hourly municipal service member, as determined by the Municipal Service Commission, who is an active member on 9-30-1994, his or her accumulated contributions as of 9-30-1994 shall be returned to him or her in a lump sum.
