§ 30.006 WORKER’S COMPENSATION COMMISSION.
   (A)   Generally.
      (1)   Report of compensation cases; expenses. Each department head of each city department shall, semi-monthly, check and report to the Board each compensation case in his or her department. This report shall state in detail the facts of each case and the nature and status of any proceedings pending in connection therewith. All disbursements in each case shall be approved by the department head prior to submission to the Board and Council for payment. The Secretary shall keep a separate account of the expenses of each department.

      (2)   Worker’s Compensation Fund; computation of payments; depository. The City Clerk shall, at the time of the making of the annual budget, inform each department head of the amount due from each department for worker’s insurance. Each department in submitting its budget shall include that item for insurance. The method of computing the amount due from each department shall be similar to the method used by the Commissioner of Insurance of the state. The amount so computed shall be placed in the Worker’s Compensation Fund hereby created, to be deposited in a bank designated by the Council, which fund shall be drawn on for no other purpose, except payment for worker’s compensation claims or expenses.

   (B)   Commission.
      (1)   Created. There is hereby created a non-charter commission to be known as the “Worker’s Compensation Commission”.

      (2)   Members.
         (a)   The Worker’s Compensation Commission shall be composed of the City Engineer, the City Attorney, the City Clerk, the Mayor and the Presidents of each of the following commissions:
            1.   Municipal Service Commission;
            2.   Police and Fire Commission; and
            3.   Public Recreation Commission.
         (b)   The President of such a Commission may designate a representative to act in his or her stead. Members of the Commission shall serve without compensation as such.

      (3)   Meetings. The meetings of the Worker’s Compensation Commission shall be at the call of the Mayor. A majority of the members shall constitute a quorum. All members of the Worker’s Compensation Commission, including, but not limited to, the Mayor, shall be entitled to vote at Commission meetings. The Commission shall, subject to the provisions of this section promulgate and adopt rules and regulations for the conduct of its business and meetings.

      (4)   Secretary. The Secretary of the Worker’s Compensation Commission shall keep all records and keep a copy of the minutes of the meetings of said Board, which shall be presented to the Council at its next regular meeting. The Secretary shall also be charged with the duty of notifying the Department of Labor and Industry of any injury or death of any city employee during the course of his or her employment, as soon as information concerning the same is received.
