§ 98.02 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   “BLOCK.” That portion of any street or public beach lying between its intersections with other streets. On Causeway Drive and the Salisbury Street causeway a block shall be 300' segments identified by the Special Events Coordinator.
   “EXPRESSIVE ACTIVITIES.” Conduct, the sole or principal object of which is the expression, dissemination or communication by verbal, visual, literary or auditory means of opinion, views or ideas and for which no fee or donation is charged or required as a condition of participation in or attendance at such activity. It includes public oratory, distribution of literature, and picketing. “EXPRESSIVE ACTIVITIES” do not include commercial activities set out in § 98.09(D).
   “GROUP DEMONSTRATION.” Any assembly together or concert of action between or among two or more persons for the purpose of protesting any matter or of making known any position or promotion of the persons, or of or on behalf of any organization or class of persons, or for the purpose of attracting attention of the assembly.
   “PARADE.” Any assemblage of two or more persons participating in or operating any vehicle in any march, ceremony, show, exhibition, or procession of any kind in or upon the public streets, sidewalks, alleys, parks, or other public grounds or places.
   “PERSON.” Any individual, firm, corporation, partnership, association, or other organization, whether formal or informal.
   “PICKET LINE.” Any two or more persons formed together for the purpose of making known any position or promotion of the persons, or on behalf of any organization or class of persons.
   “PICKETING.” The act of participating in or conducting a picket line.
   “PUBLIC BEACH.” The ocean beach as defined in G.S. § 77-20(e) and any additional area lying between the 1939 line, as defined in Ch. 155, Appendix A , and the Atlantic Ocean.
   “SMALL GROUPS.” Any formation, procession or assembly of three or fewer persons for a common purpose.
   “SPECIAL EVENT.
      (1)   A planned outdoor event which involves:
         (a)   The gathering of a group of persons for a common purpose, design or goal upon public property or the public beach; or
         (b)   An expressive activity by an individual or a group upon public property or the public beach.
      (2)   “SPECIAL EVENTS” shall include, but not be limited to, parades, group demonstrations, and picketing.
   “SPECIAL EVENTS COORDINATOR.” The person designated by the Town Manager to make decisions regarding special events that do not require approval of the Board of Aldermen.
   “TEMPORARY STRUCTURE.” Any moveable shelter or enclosure, including a tent, which is intended to provide protection from the elements for persons, stored materials, vehicles, or other items and for which no building permit is required.
   “WATER-BASED ACTIVITY.” Those activities that take place, in whole or in significant part, in the water and that would be materially altered or impaired without the ability to perform the activity in the water, for example, boating, surfing, kite boarding, wake boarding, water-skiing, wind surfing, kayaking, sailing, and triathlons.
