1173.08 PUBLIC AREA PAYMENTS.
   (a)   Every community development project owner or developer, whether or not the community development project is subject to development plan regulations, shall be required to make a cash payment to the City in the amount of two hundred fifty dollars ($250.00) per new or additional residential unit built for deposit in the Special Parks Fund. Such deposits shall be used for the capital costs associated with the City’s parks, playground and recreation areas. No public area payment shall be required for any community development project owner or developer who was required to make a dedication of land to the City pursuant to Section 1101.06(a).    (b)   The public area payment required by this section shall be made prior to the issuance of the building permit for the project.
 
   (c)   A credit shall be granted for any community development project constructed on a lot which previously contained a similar structure, but which structure was demolished on or after January 1, 1995. The credit shall be in an amount which would have been paid for such demolished structure in accordance with the schedule set forth in subsection (a) hereof. In no event shall the credit granted be greater than the payment due in connection with the new development. (Ord. 14-95. Passed 4-10-95.)
