1351.99 PENALTY.

   Whoever violates any provision of the Minimum Housing Standards and Property Maintenance Code adopted under this chapter shall be fined not less than one hundred dollars ($100.00), nor more than five hundred dollars ($500.00), or imprisoned not more than ninety days, or both. No person shall be imprisoned under this Section 1351.99 for a first offense, and the prosecution shall always be as and for a first offense unless the affidavit upon which prosecution is instituted contains the allegation that the offense is a second or repeated offense.
