923.05 INDUSTRIAL DISCHARGE PERMIT.
   (a)    Dischargers of Industrial Wastes. All dischargers of industrial wastes proposing to connect to or to discharge sewage, industrial wastes and other wastes to the POTW shall obtain an industrial discharge permit before connecting to or discharging to the POTW. All existing dischargers of industrial wastes connected to or discharging to the POTW shall also obtain an industrial discharge permit. The permit requirement may be waived upon a determination by the Director that the discharger does not meet the definition of a "significant industrial user".

   (b)   Permit Application. Dischargers of industrial wastes shall complete and file with the City, a permit application in the form prescribed by the City, and accompanied by the appropriate fee. Proposed new dischargers shall apply at least ninety days prior to connecting to the POTW. No industrial discharge permit shall be issued unless and until the following conditions have been met:
      (1)    Disclosure of name, address and location of the discharger;
      (2)   Disclosure of Standard Industrial Classification (SIC) number according to the Standard Industrial Classification Manual, Bureau of the Budget, 1972, as amended;
      (3)    Disclosure of wastewater constituents and characteristics, including but not limited to, those mentioned in this chapter;
      (4)    Disclosure of time and duration of discharges;
      (5)    Disclosure of average daily and instantaneous peak wastewater flow rates, including daily, monthly and seasonal variations, if any. All flows shall be measured unless other verifiable techniques are approved by the City due to cost or nonfeasibility;
      (6)    Disclosure of site plans, floor plans, mechanical and plumbing plans and details to show all sewers, sewer connections, inspection manholes, sampling chambers and appurtenances by size, location and elevation;
      (7)    Description of activities, facilities and plant processes on the premises including all materials which are or may be discharged to the sewers or sewage works of the City;
      (8)    Description of all materials which are or may be discharged to the POTW;
      (9)    Disclosure of each product produced by type, amount, process or processes, and rate of production;
      (10)    Disclosure of the type and amount of raw materials utilized (average and maximum per day);
      (11)    Disclosure of the anticipated nature and concentration of any pollutants or materials in the discharge;
      (12)    Signature on permit applications for new or modified permits, and all renewal applications for existing permits shall be by a principal executive officer of the discharger.
   (c)   Evaluation and Approval. The City will evaluate the application and data furnished by the discharger and may require additional information. Within thirty days after full evaluation and acceptance of the data furnished, the City shall issue an industrial discharge permit subject to the terms and conditions provided herein.

   (d)   Permit Conditions. Industrial discharge permits may include the following:
      (1)    Fees and charges to be paid upon initial permit issuance;
      (2)    Effluent limits on the average and maximum wastewater constituents and characteristics, including BMP's (if appropriate), applicable to the user based on applicable standards in federal, state and local law.

      (3)    Limits on average and maximum rate and time of discharge or requirements for flow regulations and equalization;
      (4)    Special conditions as the City may reasonably require under particular circumstances of a given discharge including sampling locations, frequency of sampling, number and types of tests, and reporting schedule;
      (5)    Requirements for submission of special technical reports or discharge reports where same differs from those prescribed by this chapter.
   (e)   Permit Modification. The City reserves the right to amend any industrial discharge permit issued hereunder in order to assure compliance by the City with applicable laws and regulations. The discharger shall be informed of any proposed changes in its permit at least thirty days prior to the effective date of change. Any changes or new conditions in the permit shall include a reasonable time schedule for compliance.
   (f)   Permit Duration. All industrial discharge permits shall be issued for a specified time period, with the maximum being five years, subject to amendment or revocation as provided in this chapter. Ninety days prior to permit expiration, the discharger shall submit an industrial discharge permit renewal application on forms available from the City.

   (g)   Limitations on Permit Transfer. Industrial discharge permits are issued to a specific discharger for a specific operation and are not assignable to another discharger without the prior written approval of the City or transferable to any other location.

   (h)   Slug Discharge Control Program.
      (1)   Each user shall provide protection from slug discharges of restricted materials or other substances regulated by this article as defined in Section 923.01(22). No significant industrial user who commences discharge to the sewerage system after adoption of this section shall be permitted to introduce pollutants into the system until the need for slug discharge control plans or procedures has been evaluated by the City. Each existing significant industrial user shall be evaluated by the City for the need for slug discharge control plans or procedures at least once by January 1, 2009.
      (2)   Certain users will be required to prepare Slug Discharge Prevention and Contingency Plans (SDPC) showing facilities and operating procedures to provide this protection. These plans shall be submitted to the City for review and approval. All existing users required to have SDPC plans shall submit such a plan within 3 months after notification from the City and complete implementation within 6 months. Review and approval of such plans and operating procedures shall not relieve the user from the responsibility to modify the user's facility as necessary to meet the requirements of this article. SDPC will be reviewed at least once during each permit cycle.
      (3)   SDPC Plans shall address at a minimum, the following:
         A.   Description of discharge practices, including nonroutine batch discharges.
         B.   Description of stored chemicals.
         C.   Procedures for immediately notifying the Sewage Treatment Plant Superintendent of any accidental or slug discharge. Such notification must also be given for any discharge which would violate any of the prohibited discharges in Section 923.04.
         D.   Procedures to prevent adverse impact from any accidental or slug discharge. Such procedures include, but are not limited to, inspection and maintenance of storage areas, handling and transfer of materials, loading and unloading operations, control of plant site runoff, worker training, building of containment structures or equipment, measures for containing toxic organic pollutants (including solvents), and/or measures and equipment for emergency response.
      (4)   In the case of a slug discharge, it is the responsibility of the user to immediately notify the Sewage Treatment Plant of the incident by telephone or in person. Information concerning the location of the discharge, type of waste, concentration and volume, and corrective action shall be provided by the user.
Within five days following a slug discharge, the user shall submit a detailed written report describing the cause of the discharge and the measures being taken by the user to prevent similar future occurrences. Such notification shall not relieve the user of any expense, loss, damage, or other liability which may be incurred as a result of damage to the sewerage system, fish kills, or any other damage to person or property, nor shall notification relieve the user of any fines, civil penalties, or other liability which may be imposed by this chapter or other applicable law.
      (5)   A notice shall be permanently posted on the user's premises advising employees of a contact to call in the event of a slug discharge. The user shall ensure that all employees who may cause or allow such slug discharge to occur are advised of the proper emergency notification procedure.
      (6)   Each user shall notify the Superintendent of any significant changes to the user's operations or system which might alter the nature, quality, or volume of its wastewater at least 30 days prior to the change.
