923.01 DEFINITIONS.
   Unless the context specifically indicates otherwise, the meaning of terms used in this chapter shall be as follows:
   (1)   "BOD" (denoting biochemical oxygen demand) means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at twenty degrees centigrade expressed in milligrams per liter.
   (2)   "Building drain" means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet (one and one-half meters) outside the inner face of the building wall.
   (3)   "Building sewer" means the extension from the building drain to the public sewer or other place of disposal.
   (4)   "City" means the City of Wooster, Ohio.
   (5)   "Combined sewer" means a sewer receiving both surface runoff and sewage.

   (6)   “Director” means the Director of Administration of the City or his/her designee. (Ord. 2011-21. Passed 9-6-11.)
   (7)   "Garbage" means solid wastes from the domestic and commercial preparation, cooking and dispensing of food, and from the handling, storage and sale of produce.
   (8)   "Industrial wastes" means the liquid wastes from industrial manufacturing processes, trade or business as distinct from sanitary sewage.
   (9)    "Natural outlet" means any outlet into a watercourse, pond, ditch, lake or other body of surface or groundwater. (Ord. 1985-21. Passed 7-10-85.)
   (10)    "Normal sewage" means residential wastewater containing suspended solids and COD concentrations based on actual measurements after establishing industrial sewage rates based on the methodology in Chapter 924.

   (11)    "Person" means any individual, firm, company, association, society, corporation or group.
   (12)    "pH" means the logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.
   (13)    "Properly shredded garbage" means the wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half inch (1.27 centimeters) in any dimension.
   (14)    "Public sewer" means a sewer in which all owners of abutting properties have equal rights, and which is controlled by public authority.
   (15)    "Sanitary sewage" means the wastewater from kitchen, bathroom, lavatory, toilet and laundry.
   (16)    "Sanitary sewer" means a sewer which carries sewage and to which storm, surface and groundwaters are not intentionally admitted.
   (17)    "Sewage"means a combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments, together with such ground, surface and stormwaters as may be present.
   (18)    "Sewage treatment plant" means all facilities for pumping, treating and disposing of sewage.
   (19)    "Sewage works" means all facilities for collecting, pumping, treating and disposing of sewage.
   (20)    "Sewer" means a pipe or conduit for carrying sewage.
   (21)    "Shall" is mandatory; "may" is permissive. (Ord. 1985-21. Passed 7-10-85.)
   (22)    "Slug Loading or Slug Discharge" means any discharge at a flow rate or concentration which could cause a violation of the prohibited discharge standards in Section 923.04. A slug discharge is any discharge of a nonroutine, episodic nature, including but not limited to an accidental spill or a noncustomary batch discharge which has a reasonable potential to cause interference or pass-through, or in any other way violate the POTW's local limits or permit conditions.

   (23)    "Storm drain" (sometimes termed "storm sewer") means a sewer which carries storm and surface waters and drainage, but excludes sewage and industrial wastes, other than unpolluted cooling water.
   (24)    "Suspended solids" means solids that either float on the surface of, or are in suspension in water, sewage or other liquids and which are removable by laboratory filtering.
   (25)    "Watercourse" means a channel in which a flow of water occurs, either continuously or intermittently.
   (26)    "COD" (denoting chemical oxygen demand) means an estimate of the proportion of the sample matter susceptible to oxidation by a strong oxidant as determined in laboratory analysis made in accordance with procedures set forth in "Standard Methods".
   (27)    "Standard Methods" means the examination and analytical procedures set forth in the most recent edition of "Standard Methods for the Examination of Water, Sewage and Industrial Wastes", published jointly by the American Public Health Association, the American Water Works Association and the Federation of Sewage and Industrial Wastes Association.
   (28)    "Industrial sewage rate" means the assessment in addition to the service charge which is levied on those persons whose wastes are greater in strength than the concentration values established as representative of normal sewage.
   (29)    "Act" means the Clean Water Act (33 U.S.C. 1251 et seq.), as amended.
   (30)    "Pretreatment" means the reduction of the amount of pollutants, the elimination of pollutants, or the alteration of the nature of pollutant properties in wastewater to a less harmful state prior to or in lieu of discharging or otherwise introducing such pollutants into a POTW.
   (31)    "Categorical Pretreatment Standards" means National Pretreatment Standards specifying quantities or concentrations of pollutants or pollutant properties which may be discharged or introduced into a POTW by specific dischargers of industrial wastes.
   (32)    "Discharger" means any user who discharges an effluent into a POTW by means of pipes, conduits, pumping stations, force mains, constructed drainage ditches, intercepting ditches and all constructed devices and appliances appurtenant thereto.
   (33)    "Other wastes" means decayed wood, sawdust, shavings, bark, lime, refuse, ashes, garbage, offal, oil, tar, chemicals and all other substances except sewage and industrial wastes.
   (34)    "O&M" means operation and maintenance.
   (35)    "POTW" (denoting publicly owned treatment works) means any sewage treatment works and the sewers and conveyance appurtenances discharging thereto, owned and operated by the City.
   (36)    "Wastewater" means industrial waste or sewage or any other waste including that which may be combined with any groundwater, surface water or stormwater that may be discharged to the POTW.
   (37)    "NPDES" means National Pollutant Discharge Elimination System Permit program as administered by the U.S. EPA or State.
   (38)    "Pollutant" means any substance discharged into a POTW or its collection system, which upon exposure to or assimilation into any organism will cause adverse effects such as cancer, genetic mutations or physiological manifestations as defined in standards issued pursuant to Section 307(a) of the Act.
   (39)    "Toxic pollutant" means substances including, but not limited to, those pollutants identified in the Toxic Pollutant List as provided by the U.S. EPA.
   (40)    "Indirect discharge" means the discharge or the introduction of nondomestic pollutants from a source regulated under Section 307(b) or (c) of the Act, into a POTW. (Ord. 1985-21. Passed 7-10-85.)
   (41)    "Interference" means a discharge which, alone or in conjunction with a discharge or discharges from other sources, both:
      A.    Inhibits or disrupts the POTW, its treatment processes or operations, or its sludge processes, use or disposal; and
      B.    Therefore is a cause of a violation of any requirement of the POTW's NPDES permit (including an increase in the magnitude or duration of a violation) or of the prevention of sewage sludge use or disposal in compliance with the following statutory provisions and regulations or permits issued thereunder (or more stringent State or local regulations): Section 405 of the Clean Water Act, the Solid Waste Disposal Act (SWDA) (including Title II, more commonly referred to as the Resource Conservation and Recovery Act (RCRA) and including State regulations contained in any State sludge management plan prepared pursuant to Subtitle D of the SWDA), the Clean Air Act, the Toxic Substances Control Act and the Marine Protection, Research and Sanitation Act.

   (42)    "Upset" means an exceptional incident in which a discharger unintentionally and temporarily is in a state of noncompliance with the standards set forth in this chapter due to factors beyond the reasonable control of the discharger and excluding noncompliance to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventive maintenance or careless or improper operation thereof.

   (43)    "New source" means any building, structure, facility or installation from which there is or may be a discharge of pollutants, the construction of which commenced after the publication of proposed pretreatment standards under Section 307(c) of the Act which will be applicable to such source if such standards are thereafter promulgated in accordance with that section.
   (44)    "Pass through" means a discharge which exits the POTW into waters of the United States in quantities or concentrations which, alone or in conjunction with a discharge or discharges from other sources, is a cause of a violation of any permit (including an increase in the magnitude or duration of a violation).

   (45)    "Significant industrial user" means:
      A.    Except as provided in subsection (45)B. hereof, "significant industrial user" includes:
         1.    All industrial users subject to categorical pretreatment standards; and
         2.    Any other industrial use that discharges an average of 25,000 gallons per day or more of process wastewater to the POTW; contributes a process wastestream which makes up five percent (5%) or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant; or has a reasonable potential, in the opinion of the Director, to adversely affect the POTW's operation or for violating any pretreatment standard or requirement.
      B.    The Director may at any time, on his own initiative or in response to a petition received from an industrial user, determine that a noncategorical industrial user is not a significant industrial user if the industrial user has no reasonable potential to adversely affect the POTW's operation or for violating any pretreatment standard or requirement.

    (46)   "BMP's" means schedules of activities, prohibitions of practices, maintenance procedures, and other management practices to implement the prohibitions listed in OAC 3745-3-04. BMPs also include treatment requirements, operating procedures, and practices to control plant site runoff, spillage or leaks, sludge waste disposal, or drainage from raw materials storage.

   (47)   “Renewal and Replacement Fund” means a portion of the sewer fund placed in reserve for necessary annual capital expenditures for maintenance, replacement, upgrade and repair to capital items within the sewage treatment, storage, pumping and collection system.
   (48)   “Septage” means the materials, both liquid and solid, removed from a septic tank or other sanitary holding facility. It contains only domestic wastewater.
